2 An act relating to dermatological services;
3 creating s. 458.3245, F.S.; requiring a
4 dermatologist to directly supervise a person
5 who is not licensed to practice medicine or
6 certified to practice advanced level nursing
7 while that person performs specified services;
8 defining terms; creating s. 459.0126, F.S.;
9 requiring a dermatologist to directly supervise
10 a person who is not licensed to practice
11 osteopathic medicine or certified to practice
12 advanced level nursing while that person
13 performs specified services; defining terms;
14 providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Section 458.3245, Florida Statutes, is
19 created to read:
20 458.3245 Dermatological supervision requirements.--
21 (1) A dermatologist must directly supervise any person
22 with whom the dermatologist has a supervisory relationship
23 within his or her dermatological practice and who is not
24 licensed to practice medicine under this chapter or certified
25 under s. 464.012 when that person:
26 (a) Evaluates any new, nonemergency patient for
27 dermatological care or treatment; or
28 (b) Encounters within the scope of his or her
29 delegated responsibilities under the dermatologist, any new
30 dermatological problem on any of the dermatologist's patients.
31 (2) As used in this section, the term:

1 (a) "Dermatological" refers to a medical condition
2 involving the skin or subcutaneous tissue.
3 (b) "Dermatologist" means any physician who has
4 successfully completed a 3-year residency in dermatology
5 approved by the Accreditation Council on Graduate Medical
6 Education and who is practicing within the scope of that
7 specialty within this state.
8 (c) "Directly supervise" means the dermatologist is
9 present in the same office suite as the person being
10 supervised.

12 This section does not apply to any dermatological procedures
13 performed within a facility licensed under chapter 395 or
14 chapter 400.
15 Section 2. Section 459.0126, Florida Statutes, is
16 created to read:
17 459.0126 Dermatological supervision requirements.--
18 (1) A dermatologist must directly supervise any person
19 with whom the dermatologist has a supervisory relationship

21 licensed to practice osteopathic medicine under this chapter
22 or certified under s. 464.012 when that person:

27 dermatological problem on any of the dermatologist's patients.

14 law.

16 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR

19 The committee substitute revises the conditions under which a
person is subject to direct supervision by a dermatologist to
20 exclude persons who practice advanced level nursing. The
committee substitute defines "dermatological" and
21 "dermatology" for purposes of providing supervision
requirements for certain persons providing dermatological care
22 or treatment under a dermatologist's supervision. The
committee substitute exempts dermatological procedures
23 performed in hospitals, ambulatory surgical centers, and
nursing homes from the supervision requirements.
