A bill to be entitled
2An act relating to preserving Florida's history; amending
3s. 267.031, F.S.; providing additional responsibilities of
4the Division of Historical Resources of the Department of
5State relating to preserving archaeological sites and
6artifacts; authorizing the division to enter into a
7memorandum of agreement with the University of West
8Florida for purposes of a network of regional public
9archaeology centers; amending s. 267.14, F.S.; providing
10additional legislative intent relating to local
11archaeology; creating s. 267.145, F.S.; requiring the
12Department of State to create a network of public
13archaeology centers for certain purposes; requiring
14administration of the network through a center at the
15University of West Florida; providing for establishing
16additional centers; creating s. 267.174, F.S.; providing a
17popular name; creating the Discovery of Florida
18Quincentennial Commemoration Commission within the
19Department of State for certain purposes; providing for
20commission membership; providing for terms of members;
21providing for successor appointment; providing for
22election of officers; requiring the commission to adopt
23bylaws; providing for commission meetings; specifying
24serving without compensation; providing for per diem and
25travel expenses; requiring the commission to develop a
26master plan for certain purposes; requiring a timetable
27and budget for the plan; requiring a report to the
28Governor and Legislature; providing responsibilities of
29the department; authorizing the appointment of
30subcommittees; requiring the Secretary of State to appoint
31an advisory committee composed of all former living
32governors of the state; requiring the commission to
33provide advice and assistance to the Department of State
34regarding master plan implementation and activities of a
35citizen support organization; specifying the appointment
36of two subcommittees; providing compensation only for per
37diem and travel expenses; requiring the Department of
38State to provide administrative support and consulting
39services subject to an appropriation; authorizing the
40Department of State to enter into contracts or accept
41loans or grants for money, property, or personal services
42to implement requirements; providing for assumption of
43other functions to carry out provisions; providing for the
44establishment of a citizen support organization for
45certain purposes; authorizing the organization to receive
46moneys for certain purposes; authorizing the Secretary of
47State to adopt a master plan; providing for legislative
48budget requests; providing for a term of existence of the
49commission and the citizen support organization; providing
50for transfer of documents and remaining assets of the
51commission and citizen support organization upon
52termination; providing an effective date.

54Be It Enacted by the Legislature of the State of Florida:
55
56     Section 1.  Paragraph (p) is added to subsection (5) of
57section 267.031, Florida Statutes, subsections (6) and (7) of
58said section are renumbered as subsections (7) and (8),
59respectively, and a new subsection (6) is added to said section,
60to read:
61     267.031  Division of Historical Resources; powers and
62duties.--
63     (5)  It is the responsibility of the division to:
64     (p)  Advise and assist, as appropriate, federal and state
65agencies, local governments, and organizations and individuals
66in the recognition, protection, and preservation of the
67archaeological sites and artifacts of this state, directly and
68through a memorandum of agreement with a network of public
69archaeology centers as described in s. 267.145.
70     (6)  The division may enter into a memorandum of agreement
71with the University of West Florida to coordinate the
72establishment and operation of a network of regional public
73archaeology centers to provide public outreach and assistance to
74local governments in identifying, evaluating, developing, and
75preserving the archaeology in their local areas and in assisting
76the division in its archaeological responsibilities as outlined
77in this chapter and the memorandum of agreement.
78     Section 2.  Section 267.14, Florida Statutes, is amended to
79read:
80     267.14  Legislative intent.--It is hereby declared to be
81the public policy of the state to preserve archaeological sites
82and objects of antiquity for the public benefit and to limit
83exploration, excavation, and collection of such matters to
84qualified persons and educational institutions possessing the
85requisite skills and purpose to add to the general store of
86knowledge concerning history, archaeology, and anthropology. It
87is further declared to be the public policy of the state to
88provide public outreach and assistance to local governments in
89identifying, evaluating, developing, and preserving the
90archaeology in their local areas through the establishment of a
91network of regional public archaeology centers. It is further
92declared to be the public policy of the state that field
93investigation activities on privately owned lands should be
94discouraged except in accordance with both the provisions and
95spirit of ss. 267.11-267.145 267.14; and persons having
96knowledge of the location of archaeological sites are encouraged
97to communicate such information to the division.
98     Section 3.  Section 267.145, Florida Statutes, is created
99to read:
100     267.145  Florida network of public archaeology centers.--
101     (1)  The Department of State shall create, through a
102memorandum of agreement, a Florida network of public archaeology
103centers to help stem the rapid deterioration of this state's
