  7         Florida Health Care Practitioner Workforce

  8         Database within the Department of Health;

  9         authorizing the database to be implemented in

10         stages; giving priority in the database for

11         information concerning allopathic and

12         osteopathic physicians; specifying basic data

13         elements of allopathic and osteopathic

14         physicians for inclusion in the database;

15         requiring that data for the health care

16         practitioner workforce database be gathered

17         from existing data sources; requiring certain

18         entities to provide basic data elements to the

19         department; authorizing the department to

20         create an advisory committee; providing that

21         the act will not take effect unless funds are

22         specifically appropriated for this purpose;

23         prohibiting the use of a specified trust fund

24         to administer the act; providing an effective

25         date.

29         Section 1.  Section 381.03015, Florida Statutes, is

 2  Database.--

 3         (1)  LEGISLATIVE FINDINGS AND INTENT.--

 4         (a)  The Legislature finds that the state health

 5  policies designed to expand patient access and improve the

 6  quality of health care delivery must take into consideration

 7  the supply, distribution, academic preparation, and

 8  utilization of the state's health care workforce. The

 9  Legislature further finds that the absence of accurate,

10  objective, relevant, and timely data concerning the health

11  care workforce in this state is a barrier to developing and

12  implementing optimal programmatic and fiscal policies relating

13  to the education and training of health care practitioners and

14  the delivery of health care services.

15         (b)  In order to eliminate these barriers, it is the

16  intent of the Legislature to create the Florida Health Care

17  Practitioner Workforce Database within the Department of

18  Health. The database shall provide the capacity for the

19  collection, compilation, maintenance, and analysis of data

20  concerning the state's health care workforce. It is further

21  the intent of the Legislature that the workforce database

22  serve as the official state repository of data that can be

23  used by the Legislature, the Executive Office of the Governor,

24  state agencies, and state, regional, and local entities

25  involved in planning, analysis, and policy development for the

26  health care workforce and in the delivery of health care

27  services.

28         (2) DEFINITIONS.--As used in this section, the term:

29         (a)  "Department" means the Department of Health.

30         (b)  "Health care practitioner" has the same meaning as

31  provided in s. 456.001.

 1         (3)  FLORIDA HEALTH CARE PRACTITIONER WORKFORCE

 2  DATABASE.--

 3         (a)  The Florida Health Care Practitioner Workforce

 4  Database is the electronic repository of basic data elements

 5  for each health care profession identified by the department

 6  for inclusion in the database. Basic data elements shall be

 7  maintained for as many years as necessary to allow for an

 8  analysis of longitudinal trends. To the maximum extent

 9  feasible, data elements must be collected and maintained using

10  standardized definitions in order to allow for multistate or

11  national comparisons of this state's data.

12         (b)  The workforce database may be implemented in

13  phases; however, the highest priority must be given to

14  including the basic data elements for allopathic and

15  osteopathic physicians in the database. Inclusion of basic

16  data elements for other health care professions may be

17  accomplished in subsequent phases, as resources allow. The

18  department shall develop an implementation plan that

19  identifies the priority order by which other health care

20  professions may be added to the database.

21         (4)  The basic data elements for allopathic and

22  osteopathic physicians shall include, at a minimum, the

23  following:

24         (a)  Data elements for each allopathic and osteopathic

25  physician licensed to practice in this state:

26         1.  Name.

27         2.  Date of birth.

28         3.  Place of birth.

29         4.  Gender.

30         5.  Race.

31         6.  Social security number.

 1         7.  Name of medical school.

 2         8.  Year of graduation from medical school.

 3         9.  Location of medical school.

 4         10.  Name of each graduate medical education program

 5  completed.

 6         11.  Year of completion of each graduate medical

 7  education program.

 8         12.  Location of each graduate medical education

 9  program completed.

10         13.  Type of each graduate medical education program

11  completed, such as internship, residency, or fellowship.

12         14.  Each medical specialty or subspecialty practiced.

13         15.  Each medical specialty board certification held.

14         16.  Each practice location, including the street

15  address, municipality, county, and zip code for each location

16  and an indication of the percentage of time spent in each

17  practice location, if more than one is indicated.

18         17.  Each practice setting, by major category of

19  practice setting. Practice setting categories include, but are

20  not limited to, private solo or group office, hospital,

21  managed care organization, health maintenance organization,

22  nursing home, and county health department. The practice

23  setting shall be identified for each practice location

24  indicated.

25         18.  Whether or not the physician is a full-time

26  faculty member at a medical school.

27         19.  Whether the physician intends to reduce his or her

28  practice volume by 50 percent or more within the effective

29  period of the initial or renewal license.

30         (b)  Data elements for each graduate of a Florida

31  allopathic or osteopathic medical school:

 1         1.  Name.

 2         2.  Date of birth.

 3         3.  Place of birth.

 4         4.  Gender.

 5         5.  Race.

 6         6.  Social security number.

 7         7.  Name of medical school.

 8         8.  Year of graduation from medical school.

 9         9.  Name of the graduate medical education program that

10  the graduate plans to enter.

11         10.  Type of the graduate medical education program,

12  such as internship or residency, which the graduate plans to

13  enter.

14         11.  Location of the graduate medical education

15  program.

16         12.  Anticipated area of practice specialty or

17  subspecialty upon completion of the graduate medical education

18  program.

19         13.  Anticipated practice location, including the

20  municipality, state, and country.

21         (c)  Data elements for each allopathic or osteopathic

22  physician completing a graduate medical education program in

23  this state:

24         1.  Name.

25         2.  Date of birth.

26         3.  Place of birth.

27         4.  Gender.

28         5.  Race.

29         6.  Social security number.

30         7.  Name of medical school.

31         8.  Year of graduation from medical school.

 1         9.  Location of medical school.

 2         10.  Whether the individual intends to enter a

 3  subsequent graduate medical education program prior to

 4  practice and, if so, the name and location of the graduate

 5  medical education program.

 6         11.  Anticipated area of practice specialty or

 7  subspecialty upon completion of the graduate medical education

 8  program.

 9         12.  Anticipated practice location, including the

10  municipality, state, and country.

12  The data elements collected for nurses shall be identified by

13  the department, based upon recommendations made by the Florida

14  Center for Nursing.

15         (5)  REQUIRED USE OF EXISTING DATA SOURCES.--

16         (a)  It is the intent of the Legislature to minimize

17  the cost of creating and operating the Florida Health Care

18  Practitioner Workforce Database and to avoid unwarranted

19  duplication of existing data currently collected and

20  maintained by the department, the Agency for Health Care

21  Administration, the Department of Education, or other state

22  agencies.

23         (b)  Therefore, to the maximum extent possible, the

24  data included in the workforce database shall be derived from

25  existing data sources. New data shall be collected for

26  inclusion in the workforce database only when the department

27  determines that such data is essential for evaluating and

28  analyzing the health care professions and when such data

29  cannot be obtained from existing sources.

30         (6)(a)  Data elements sought to satisfy paragraph

31  (4)(a) shall be obtained from the licensing processes of the

 1  Board of Medicine and the Board of Osteopathic Medicine under

 2  s. 456.039, and from the profiling process for health care

 3  practitioners under s. 456.041.

 4         (b)  Each medical school in this state shall annually

 5  submit the data elements described in paragraph (4)(b) to the

 6  department, in a manner prescribed by the department.

 7         (c)  Each graduate medical education program in this

 8  state shall annually submit the data elements described in

 9  paragraph (4)(c) to the department, in the manner prescribed

10  by the department.

11         (7)  IMPLEMENTATION.--

12         (a)  The Secretary of Health may establish an advisory

13  committee to monitor the creation and implementation of the

14  Florida Health Care Practitioner Workforce Database.

15         (b)  The department may employ or assign agency staff

16  or may contract, on a competitive-bid basis, with an

17  appropriate entity to administer the workforce database.

18         (8)  CONFIDENTIALITY OF DATA.--The Florida Health Care

19  Practitioner Workforce Database is intended to provide data

20  for statistical analysis. Any information or record that the

21  department obtains from any governmental entity, medical

22  school, or university for the purpose of compiling the

23  workforce database or substantiating other information or

24  records submitted for that purpose which is otherwise exempt

25  from public disclosure shall remain exempt as otherwise

26  provided by law.

27         Section 2.  This act shall not take effect unless

28  sufficient funds are allocated in a specific appropriation or

29  in the General Appropriations Act for the 2004-2005 fiscal

30  year to fund the Florida Health Care Practitioner Workforce

 1  Database. The Medical Quality Assurance Trust Fund may not be

 2  used to fund the administration of this act.

 3         Section 3.  This act shall take effect upon becoming a

 4  law.

 8    Creates the Florida Health Care Practitioner Workforce
      Database in the Department of Health. Authorizes the
 9    database to be implemented in stages. Gives priority in
      the database to allopathic and osteopathic physicians.

      osteopathic physicians to be included in the health care
11    practitioner workforce database. Requires that data for
      the workforce database be gathered from existing data
12    sources. Requires certain entities to provide basic data
