| 8 | Be It Enacted by the Legislature of the State of Florida: |
| 9 |

| 10 | Section 1. Paragraph (d) of subsection (3) of section |
| 11 | 849.085, Florida Statutes, is amended to read: |
| 12 | 849.085 Certain penny-ante games not crimes; |
| 13 | restrictions.-- |
| 14 | (3) A penny-ante game is subject to the following |
| 15 | restrictions: |
| 16 | (d) A person may not solicit participants by means of |
| 17 | advertising in any form, advertise the time or place of any |
| 18 | penny-ante game, or advertise the fact that he or she will be a |
| 19 | participant in any penny-ante game. This paragraph shall not |
| 20 | apply to the conduct of any penny-ante game within the common |
| 21 | elements or common area of a condominium, cooperative, |
| 22 | residential subdivision, or mobile home park, the dwelling of an |
| 23 | eligible organization as defined in subsection (2), or a |
| 24 | publicly owned community center owned by a municipality or |
| 25 | county. |
| 26 | Section 2. This act shall take effect upon becoming a law. |
