11 The Committee on Natural Resources recommended the following
12 amendment:

15 On page 7, between lines 5 and 6,

17 insert:
18 (c) The department shall adopt rules to establish
19 priorities for state-conducted cleanup at sport shooting or
20 training ranges based upon factors that include, but need not
21 be limited to:
22 1. The degree to which human health, safety, or
23 welfare may be affected by exposure to the contamination;
24 2. The size of the population or area affected by the
25 contamination;
26 3. The present and future uses of the affected aquifer
27 or surface waters, with particular consideration as to the
28 probability that the contamination is substantially affecting,
29 or will migrate to and substantially affect, a known public or
30 private source of potable water; and
31 4. The effect of the contamination on the environment.

1 5. In the case of projects with equal priority, the
2 extent to which other financial assistance is available.

4 Nothing in this paragraph shall be construed to restrict the
5 department from modifying the priority status of a
6 rehabilitation site where conditions warrant, taking into
7 consideration the actual distance between the contamination
8 site and groundwater or surface water receptors or other
9 factors that affect the risk of exposure to contaminants of
10 concern.
