1 A bill to be entitled
2 An act relating to service charges; amending
3 ss. 319.32 and 320.04, F.S.; increasing certain
4 service charges; providing for periodic
5 adjustments based upon the Consumer Price
6 Index; providing criteria; authorizing the
7 Department of Highway Safety and Motor Vehicles
8 to make such adjustments by rule; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (a) of subsection (2) of section
14 319.32, Florida Statutes, is amended to read:
15 319.32 Fees; service charges; disposition.--
16 (2)(a) There shall be a service charge of $7 $4.25 for
17 each application which is handled in connection with the
18 issuance, duplication, or transfer of any certificate of
19 title. There shall be a service charge of $1.25 for each
20 application which is handled in connection with the
21 recordation or notation of a lien on a motor vehicle or mobile
22 home which is not in connection with the purchase of such
23 vehicle.
24 Section 2. Paragraph (a) of subsection (1) of section
25 320.04, Florida Statutes, is amended, and subsection (4) is
26 added to that section, to read:
27 320.04 Registration service charge.--
28 (1)(a) There shall be a service charge of $3 $2.50 for
29 each application which is handled in connection with original
30 issuance, duplicate issuance, or transfer of any license
31 plate, mobile home sticker, or validation sticker or with

1 transfer or duplicate issuance of any registration
2 certificate. There may also be a service charge of up to $1
3 for the issuance of each license plate validation sticker,
4 vessel decal, and mobile home sticker issued from an automated
5 vending facility or printer dispenser machine which shall be
6 payable to and retained by the department to provide for
7 automated vending facilities or printer dispenser machines
8 used to dispense such stickers and decals by each tax
9 collector's or license tag agent's employee.
10 (4) The service charges imposed pursuant to ss.
11 319.32(2)(a) and paragraph (1)(a) shall consist of the
12 statutory amount adjusted to reflect changes in the Consumer
13 Price Index every 3 years after July 1, 2004. The Department
14 of Highway Safety and Motor Vehicles shall by rule adjust the
15 statutory amount based on increase or decrease in the Consumer
16 Price Index for all urban consumers published by the United
17 States Department of Labor. Adjustment shall be made July 1 of
18 each third year after July 1, 2004, using the most recent
19 month for which data are available at the time of the
20 adjustment. Any increase shall be rounded to the nearest 5
21 cents.
22 Section 3. This act shall take effect July 1, 2004.
