A bill to be entitled
2An act relating to water management district employees,
3appointees, and contractors; creating s. 373.6055, F.S.;
4authorizing water management districts to require the
5screening of an employee, appointee, or applicant for a
6position critical to security or public safety;
7authorizing the screening of a contractor or an employee
8thereof, vendor, repair person, or delivery person who has
9access to certain public facilities; requiring that
10fingerprints of applicants and employees be submitted to
11the Department of Law Enforcement and the Federal Bureau
12of Investigation for a check of criminal history records;
13authorizing the county or municipality to use information
14obtained from a criminal history record check to determine
15a person's eligibility for employment or appointment;
16providing an effective date.

18Be It Enacted by the Legislature of the State of Florida:

20     Section 1.  Section 373.6055, Florida Statutes, is created
21to read:
22     373.6055  Criminal history record checks for certain water
23management district employees, appointees, and
24contractors.--Notwithstanding chapter 435, a water management
25district is authorized to conduct employment screening for any
26position of water management district employment or appointment
27which the water management district finds is critical to
28security or public safety, or for any private contractor,
29employee of a private contractor, vendor, repair person, or
30delivery person who has access to any public facility or
31publicly operated facility the water management district finds
32is critical to security or safety. The water management district
33may require each person applying for, or continuing employment
34in, any such position or having access to any such facility to
35be fingerprinted. The fingerprints shall be submitted to the
36Department of Law Enforcement for a state criminal history
37record check and to the Federal Bureau of Investigation for a
38national criminal history record check. The information obtained
39from the criminal history record checks conducted pursuant to
40the policy may be used by the water management district to
41determine an applicant?s eligibility for employment or
42appointment and to determine an employee?s eligibility for
43continued employment. This section is not intended to preempt or
44prevent any other background screening, including, but not
45limited to, criminal history background checks, that a water
46management district may lawfully undertake.
47     Section 2.  This act shall take effect upon becoming a law.
