6An act relating to water management district employees,
7appointees, and contractors; creating s. 373.6055, F.S.;
8authorizing water management districts to require the
9screening of an employee, appointee, or applicant for a
10position critical to security or public safety;
11authorizing the screening of a contractor or an employee
12thereof, vendor, repair person, or delivery person who has
13access to certain public facilities; requiring that
14fingerprints of applicants and employees be submitted to
15the Department of Law Enforcement and the Federal Bureau
16of Investigation for a check of criminal history records;
17authorizing the county or municipality to use information
18obtained from a criminal history record check to determine
19a person's eligibility for employment or appointment;
20providing an effective date.

22Be It Enacted by the Legislature of the State of Florida:

24     Section 1.  Section 373.6055, Florida Statutes, is created
25to read:
26     373.6055  Criminal history record checks for certain water
27management district employees, appointees, and contractors.--A
28water management district is authorized to conduct employment
29screening for any position of water management district
30employment or appointment which the water management district
31finds is critical to security or public safety, or for any
32private contractor, employee of a private contractor, vendor,
33repair person, or delivery person who has access to any public
34facility or publicly operated facility the water management
35district finds is critical to security or safety. The water
36management district may require each person applying for, or
37continuing employment in, any such position or having access to
38any such facility to be fingerprinted. The fingerprints shall be
39submitted to the Department of Law Enforcement for a state
40criminal history record check and to the Federal Bureau of
41Investigation for a national criminal history record check. The
42information obtained from the criminal history record checks
43conducted pursuant to the policy may be used by the water
44management district to determine an applicant's eligibility for
45employment or appointment and to determine an employee's
