  1                      A bill to be entitled

  2         An act relating to traffic; amending s.

  3         316.006, F.S.; providing for jurisdiction and

  4         authority of municipalities to regulate

  5         commercial vehicle traffic; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Paragraph (c) is added to subsection (2) of

11  section 316.006, Florida Statutes, to read:

12         316.006  Jurisdiction.--Jurisdiction to control traffic

13  is vested as follows:

14         (2)  MUNICIPALITIES.--

15         (c)  Municipalities shall have jurisdiction and

16  authority to regulate and restrict commercial vehicle traffic

17  over all streets and highways located within their boundaries

18  by granting permits, franchises, and licenses or by otherwise

19  exercising such authority. The purpose of this paragraph is to

20  reinforce the long-standing policy of this state.

22  This subsection shall not limit those counties which have the

23  charter powers to provide and regulate arterial, toll, and

24  other roads, bridges, tunnels, and related facilities from the

25  proper exercise of those powers by the placement and

26  maintenance of traffic control devices which conform to the

27  manual and specifications of the Department of Transportation

28  on streets and highways located within municipal boundaries.

29         Section 2.  This act shall take effect upon becoming a

30  law.
