1 A bill to be entitled
2 An act relating to traffic; amending s.
3 316.006, F.S.; providing for jurisdiction and
4 authority of municipalities to grant permits,
5 licenses, or franchises or otherwise regulate
6 sightseeing operations; specifying that no
7 liability arises for municipalities for
8 exercising their rights to regulate sightseeing
9 operations; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (c) is added to subsection (2) of
14 section 316.006, Florida Statutes, to read:
15 316.006 Jurisdiction.--Jurisdiction to control traffic
16 is vested as follows:
17 (2) MUNICIPALITIES.--
18 (c) Without limiting, modifying, or restricting any
19 other statutory, contractual, or common-law municipal powers,
20 the Legislature expressly reaffirms the policy of this state
21 that municipalities may grant permits, licenses, or franchises
22 or may otherwise regulate sightseeing operations on public
23 rights-of-way within their jurisdictions. This paragraph is
24 solely intended to clarify that liability does not arise for
25 municipalities or their permittees, licensees, or franchisees
26 under chapter 542 for regulating sightseeing operations as
27 described in this paragraph.

29 This subsection shall not limit those counties which have the
30 charter powers to provide and regulate arterial, toll, and
31 other roads, bridges, tunnels, and related facilities from the

1 proper exercise of those powers by the placement and
2 maintenance of traffic control devices which conform to the
3 manual and specifications of the Department of Transportation
4 on streets and highways located within municipal boundaries.
5 Section 2. This act shall take effect upon becoming a
6 law.
