10 | Be It Enacted by the Legislature of the State of Florida: |
11 |

12 | Section 1. Section 288.833, Florida Statutes, is created |
13 | to read: |
14 | 288.833 State Homeland Security Trust Fund.-- |
15 | (1) There is created the State Homeland Security Trust |
16 | Fund, to be administered by the Department of Law Enforcement. |
17 | Funds shall be credited to the trust fund as provided in s. |
18 | 288.857(4)(c), to be used for the purposes of the "Florida |
19 | Commerce With Terrorist States Act" as set forth in s. 288.857. |
20 | (2) Notwithstanding the provisions of s. 216.301 and |
21 | pursuant to s. 216.351, any balance in the trust fund at the end |
22 | of any fiscal year shall remain in the trust fund at the end of |
23 | the year and shall be available for carrying out the purposes of |
24 | the trust fund. |
25 | (3) In accordance with s. 19(f)(2), Art. III of the State |
26 | Constitution, the State Homeland Security Trust Fund shall be |
27 | terminated on July 1, 2008, unless terminated sooner. Before |
28 | its scheduled termination, the trust fund shall be reviewed as |
29 | provided in s. 215.3206(1) and (2). |
30 | Section 2. This act shall take effect July 1, 2004, if |
31 | House Bill 1193 or similar legislation creating the Florida |
32 | Commerce With Terrorist States Act is adopted in the same |
33 | legislative session or an extension thereof and becomes law. |
