| 17 | Be It Enacted by the Legislature of the State of Florida: |
| 18 |
|
| 19 | Section 1. Section 288.833, Florida Statutes, is created |
| 20 | to read: |
| 21 | 288.833 State Homeland Security Trust Fund.-- |
| 22 | (1) There is created the State Homeland Security Trust |
| 23 | Fund, to be administered by the Division of Emergency Management |
| 24 | within the Department of Community Affairs. Funds shall be |
| 25 | credited to the trust fund as provided in s. 288.857(4)(c), to |
| 26 | be used to fund state homeland security with priorities for |
| 27 | funding to focus on costs not funded by the Federal Government, |
| 28 | such as operational costs of security at seaports and other |
| 29 | venues. Requests for funding shall be reviewed by the Domestic |
| 30 | Security Oversight Board which shall provide recommended funding |
| 31 | priorities. |
| 32 | (2) Notwithstanding the provisions of s. 216.301 and |
| 33 | pursuant to s. 216.351, any balance in the trust fund at the end |
| 34 | of any fiscal year shall remain in the trust fund at the end of |
| 35 | the year and shall be available for carrying out the purposes of |
| 36 | the trust fund. |
| 37 | (3) In accordance with s. 19(f)(2), Art. III of the State |
| 38 | Constitution, the State Homeland Security Trust Fund shall be |
| 39 | terminated on July 1, 2008, unless terminated sooner. Before its |
| 40 | scheduled termination, the trust fund shall be reviewed as |
| 41 | provided in s. 215.3206(1) and (2). |
| 42 | Section 2. This act shall take effect July 1, 2004, if |
| 43 | House Bill 1193 or similar legislation creating the Florida |
| 44 | Commerce With Terrorist States Act is adopted in the same |
| 45 | legislative session or an extension thereof and becomes law. |
