8creating s. 288.833, F.S.; creating the State Homeland
9Security Trust Fund, to be administered by the Division of
10Emergency Management within the Department of Community
11Affairs; providing for sources of funds and purposes;
12providing for review of requests for funding; providing
13for annual carry-forward of unused funds; providing for
14review and termination or re-creation of the trust fund;
15providing a contingent effective date.

17Be It Enacted by the Legislature of the State of Florida:
18
19     Section 1.  Section 288.833, Florida Statutes, is created
20to read:
21     288.833 State Homeland Security Trust Fund.--
22     (1)  There is created the State Homeland Security Trust
23Fund, to be administered by the Division of Emergency Management
24within the Department of Community Affairs. Funds shall be
25credited to the trust fund as provided in s. 288.857(4)(c), to
26be used to fund state homeland security with priorities for
27funding to focus on costs not funded by the Federal Government,
28such as operational costs of security at seaports and other
29venues. Requests for funding shall be reviewed by the Domestic
30Security Oversight Board which shall provide recommended funding
31priorities.
32     (2)  Notwithstanding the provisions of s. 216.301 and
33pursuant to s. 216.351, any balance in the trust fund at the end
34of any fiscal year shall remain in the trust fund at the end of
35the year and shall be available for carrying out the purposes of
36the trust fund.
37     (3)  In accordance with s. 19(f)(2), Art. III of the State
38Constitution, the State Homeland Security Trust Fund shall be
39terminated on July 1, 2008, unless terminated sooner. Before its
40scheduled termination, the trust fund shall be reviewed as
41provided in s. 215.3206(1) and (2).
42     Section 2.  This act shall take effect July 1, 2004, if
43House Bill 1193 or similar legislation creating the Florida
44Commerce With Terrorist States Act is adopted in the same
45legislative session or an extension thereof and becomes law.
