A bill to be entitled
2An act relating to the State Homeland Security Trust Fund;
3creating s. 288.833, F.S.; creating the State Homeland
4Security Trust Fund, to be administered by the Division of
5Emergency Management within the Department of Community
6Affairs; providing for sources of funds and purposes;
7providing for review of requests for funding; providing
8for annual carry-forward of unused funds; providing for
9review and termination or re-creation of the trust fund;
10providing a contingent effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Section 288.833, Florida Statutes, is created
15to read:
16     288.833 State Homeland Security Trust Fund.--
17     (1)  There is created the State Homeland Security Trust
18Fund, to be administered by the Division of Emergency Management
19within the Department of Community Affairs. Funds shall be
20credited to the trust fund as provided in s. 288.857(4)(c), to
21be used to fund state homeland security with priorities for
22funding to focus on costs not funded by the Federal Government,
23such as operational costs of security at seaports and other
24venues. Requests for funding shall be reviewed by the Domestic
25Security Oversight Board which shall provide recommended funding
26priorities.
27     (2)  Notwithstanding the provisions of s. 216.301 and
28pursuant to s. 216.351, any balance in the trust fund at the end
29of any fiscal year shall remain in the trust fund at the end of
30the year and shall be available for carrying out the purposes of
31the trust fund.
32     (3)  In accordance with s. 19(f)(2), Art. III of the State
33Constitution, the State Homeland Security Trust Fund shall be
34terminated on July 1, 2008, unless terminated sooner. Before its
35scheduled termination, the trust fund shall be reviewed as
36provided in s. 215.3206(1) and (2).
37     Section 2.  This act shall take effect July 1, 2004, if
38House Bill 1193 or similar legislation creating the Florida
39Commerce With Terrorist States Act is adopted in the same
40legislative session or an extension thereof and becomes law.
