1 A bill to be entitled
2 An act relating to use of social security
3 numbers in public postsecondary education;
4 creating s. 1004.09, F.S.; prohibiting certain
5 uses of a student's social security number by
6 state universities and community colleges;
7 providing exceptions; requiring the development
8 and implementation of a plan by each state
9 university and community college; providing for
10 injunctive relief; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Section 1004.09, Florida Statutes, is
15 created to read:
16 1004.09 Improper use of social security numbers.--
17 (1) No state university or community college shall:
18 (a) Use a social security number as an identification
19 number to identify a student.
20 (b) Publicly post or publicly display in any manner a
21 student's social security number. "Publicly post" or "publicly
22 display" means to intentionally communicate or otherwise make
23 available to the general public. This paragraph does not apply
24 to records of the clerks of court which are governed by the
25 provisions of s. 119.07(3)(ff).
26 (c) Print a student's social security number on any
27 identification document issued by a state university or
28 community college. An identification document includes, but is
29 not limited to, a professional license, student identification
30 card, driver's license, Medicaid card, or health insurance
31 card.

1 (d) Require a student to transmit his or her social
2 security number over the Internet unless the connection is
3 secure and the social security number is encrypted.
4 (e) Require a student to use his or her social
5 security number to access an Internet website unless a
6 password or unique personal identification number or other
7 authentication device is also required to access the Internet
8 website.
9 (2) Each state university and community college shall
10 develop a plan to implement the requirements of subsection (1)
11 which shall apply to students enrolled after July 1, 2005. The
12 plan shall include provisions for educating staff regarding
13 the proper and improper uses of social security numbers. The
14 plan shall be submitted to the Governor, the President of the
15 Senate, and the Speaker of the House of Representatives by
16 February 1, 2005, and shall be implemented no later than July
17 1, 2005.
18 (3) Beginning July 1, 2005, any affected student may
19 petition the circuit court for an order directing compliance
20 with this section.
21 Section 2. This act shall take effect July 1, 2004.
