1 A bill to be entitled
2 An act relating to the use of social security
3 numbers in public postsecondary education;
4 creating s. 1004.09, F.S.; prohibiting certain
5 uses of student social security numbers by
6 state universities, community colleges, and
7 public postsecondary technical centers;
8 requiring each state university, community
9 college, and public postsecondary technical
10 center to review policies and procedures and
11 submit a plan; requiring each state university,
12 community college, and public postsecondary
13 technical center to annually document
14 compliance in a report; providing for
15 injunctive relief; providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Section 1004.09, Florida Statutes, is
20 created to read:
21 1004.09 Improper use of social security numbers.--
22 (1) No state university, community college, or public
23 postsecondary technical center shall:
24 (a) Require a student to transmit his or her social
25 security number over the Internet unless the connection is
26 secure and the social security number is encrypted.
27 (b) Require a student to use his or her social
28 security number to access an Internet website unless a
29 password or unique personal identification number or other
30 authentication device is also required to access the Internet
31 website.

1 (2) Each state university, community college, and
2 public postsecondary technical center shall review its
3 policies and procedures relating to social security numbers
4 and other student identifying information and submit a plan
5 that minimizes the opportunity for student identity theft. The
6 plan shall describe how subsection (1) is to be implemented.
7 The plan shall also include provisions for educating staff
8 regarding the proper and improper uses of social security
9 numbers and other student identifying information. Each state
10 university shall submit the plan to the Governor, the Board of
11 Governors, the President of the Senate, and the Speaker of the
12 House of Representatives by February 1, 2005, and shall
13 implement the plan no later than July 1, 2005. Each community
14 college and public postsecondary technical center shall submit
15 the plan to the Governor, the State Board of Education, the
16 President of the Senate, and the Speaker of the House of
17 Representatives by February 1, 2005, and shall implement the
18 plan no later than July 1, 2005.
19 (3) Each state university shall annually submit a
20 report documenting compliance with the provisions of ss.
21 119.0721 and 1002.22 to the Board of Governors, and each
22 community college and public postsecondary technical center
23 shall annually submit a report documenting compliance with the
24 provisions of ss. 119.0721 and 1002.22 to the State Board of
25 Education.
26 (4) Beginning December 1, 2005, any affected student
27 may petition the circuit court for an order directing
28 compliance with this section.
29 Section 2. This act shall take effect July 1, 2004.

4 Removes certain prohibitions on use of social security numbers
because social security numbers are already confidential and
5 exempt pursuant to s. 119.0721, F.S., and universities,
community colleges, and postsecondary technical centers are
6 already required to comply with that provision.
7 Requires each state university, community college, and public
postsecondary technical center to review its policies and
8 procedures relating to social security numbers and other
student identifying numbers and to submit a plan that
9 minimizes the opportunity for student identity theft.
10 Requires submission of compliance reports.
