1 A bill to be entitled
2 An act relating to instructional materials for
3 K-12 public education; authorizing the
4 Department of Education to conduct a pilot
5 program; authorizing a pilot program within
6 specified counties to enable selected school
7 districts to realize cost savings in the
8 purchase of used instructional materials;
9 imposing requirements on the vendors of such
10 materials; absolving the state from
11 responsibility for certain financial losses;
12 requiring the Council for Education Policy
13 Research and Improvement to report to the
14 Legislature; providing for future repeal;
15 providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Notwithstanding section 1006.37, Florida
20 Statutes, the Department of Education may conduct a pilot
21 program to enable selected school districts to realize cost
22 savings without loss of quality or availability for individual
23 students in the purchase of used instructional materials. The
24 school districts of Hernando County, Pasco County, and Polk
25 County may participate in the pilot program. Charter schools
26 in those school districts may also participate in the pilot
27 program. When a secondhand book dealer or other third-party
28 book vendor provides used adopted instructional materials to a
29 school district, the dealer or vendor must certify the
30 availability of the used instructional materials, provide the
31 International Standard Book Number of each of the used

1 instructional materials, and certify that such materials are
2 not samples or first printings, are the most currently
3 adopted, Florida-specific instructional materials, and conform
4 to the Sunshine State Standards. The state is not responsible
5 for financial loss caused by the school district's deviating
6 from the requirements of section 1006.37, Florida Statutes.
7 The Council for Education Policy Research and Improvement
8 shall submit to the President of the Senate and the Speaker of
9 the House of Representatives for consideration during the 2005
10 Regular Session a report of the cost savings to school
11 districts based on results of the pilot program. This section
12 is repealed July 1, 2007.
13 Section 2. This act shall take effect July 1, 2004.

16 SENATE SUMMARY
17 Authorizes the Department of Education to conduct a pilot

19 requirements on the vendors of such materials. Absolves
