| 4 | reasonable charges due a charitable hospital located in |
| 5 | Collier County under a contract or agreement entered into |
| 6 | between such hospital and a nongovernmental third-party |
| 7 | payor; providing an effective date. |

| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |

| 11 | Section 1. Subsection (4) of section 1 of chapter 2003- |
| 12 | 360, Laws of Florida, is amended to read: |
| 13 | Section 1. |
| 14 | (4) If no amount is paid or is at any time payable under |
| 15 | any third-party-payor contract or agreement between the hospital |
| 16 | and third-party payors, or from any other private, public, |
| 17 | county, state, or federal insurance, contract, agreement, |
| 18 | benefit, program, or plan, the amount of reasonable charges must |
| 19 | be determined under the nongovernmental third-party-payor |
| 20 | contract or agreement entered into between the hospital and a |
| 21 | nongovernmental third-party payor which provides for the lowest |
| 22 | charges agreed to as acceptable by the hospital, taking into |
| 23 | account all reductions and write-offs provided for in the |
| 24 | nongovernmental third-party-payor contract or agreement in |
| 25 | effect at the time the charges were incurred. |
| 26 | Section 2. This act shall take effect July 1, 2004. |
