House Memorial
2A memorial to the Congress of the United States, urging
3Congress to work to allow a timely vote on the floor of
4the United States Senate on all judicial nominations.

6     WHEREAS, Article II, Section 2 of the United States
7Constitution states the President "shall nominate, and by and
8with the Advice and Consent of the Senate, shall appoint
9Ambassadors, other public Ministers and Consuls, Judges of the
10Supreme Court, and all other Officers of the United States," and
11     WHEREAS, the Administrative Office of the United States
12Courts has classified 22 judgeships as "judicial emergencies,"
13and
14     WHEREAS, 43 of President George W. Bush's judicial nominees
15are pending before the United States Senate, and
16     WHEREAS, 63 percent of President Bush's court of appeals
17nominations have been to fill seats classified as judicial
18emergencies, and
19     WHEREAS, 42 percent of President Bush's district court
20nominations have been to fill seats classified as judicial
21emergencies, and
22     WHEREAS, a minority of senators have used dilatory tactics
23to prevent a Senate floor vote on six of President Bush's
24judicial nominees, all of whom were reported favorably by the
25Committee on the Judiciary, and
26     WHEREAS, each of President Bush's judicial nominees
27reported favorably by the Committee on the Judiciary enjoys the
28support of a majority of the United States Senate, as is
29required by the United States Constitution, NOW, THEREFORE,

31Be It Resolved by the Legislature of the State of Florida:
32
33     That the Congress of the United States is requested to work
34to allow a timely vote on the floor of the United States Senate
35on all judicial nominations.
36     BE IT FURTHER RESOLVED that copies of this memorial be
37dispatched to the President of the United States, to the
38President of the United States Senate, to the Speaker of the
39United States House of Representatives, and to each member of
40the Florida delegation to the United States Congress.
