| 2 | A memorial to the Congress of the United States, urging |
| 3 | Congress to work to allow a timely vote on the floor of |
| 4 | the United States Senate on all judicial nominations. |

| 6 | WHEREAS, Article II, Section 2 of the United States |
| 7 | Constitution states the President "shall nominate, and by and |
| 8 | with the Advice and Consent of the Senate, shall appoint |
| 9 | Ambassadors, other public Ministers and Consuls, Judges of the |
| 10 | Supreme Court, and all other Officers of the United States," and |
| 11 | WHEREAS, the Administrative Office of the United States |
| 12 | Courts has classified 22 judgeships as "judicial emergencies," |
| 13 | and |
| 14 | WHEREAS, 43 of President George W. Bush's judicial nominees |
| 15 | are pending before the United States Senate, and |
| 16 | WHEREAS, 63 percent of President Bush's court of appeals |
| 17 | nominations have been to fill seats classified as judicial |
| 18 | emergencies, and |
| 19 | WHEREAS, 42 percent of President Bush's district court |
| 20 | nominations have been to fill seats classified as judicial |
| 21 | emergencies, and |
| 22 | WHEREAS, a minority of senators have used dilatory tactics |
| 23 | to prevent a Senate floor vote on six of President Bush's |
| 24 | judicial nominees, all of whom were reported favorably by the |
| 25 | Committee on the Judiciary, and |
| 26 | WHEREAS, each of President Bush's judicial nominees |
| 27 | reported favorably by the Committee on the Judiciary enjoys the |
| 28 | support of a majority of the United States Senate, as is |
| 29 | required by the United States Constitution, NOW, THEREFORE, |

| 31 | Be It Resolved by the Legislature of the State of Florida: |
| 32 |
|
| 33 | That the Congress of the United States is requested to work |
| 34 | to allow a timely vote on the floor of the United States Senate |
| 35 | on all judicial nominations. |
| 36 | BE IT FURTHER RESOLVED that copies of this memorial be |
| 37 | dispatched to the President of the United States, to the |
| 38 | President of the United States Senate, to the Speaker of the |
| 39 | United States House of Representatives, and to each member of |
| 40 | the Florida delegation to the United States Congress. |
