2 An act relating to the Chief of Domestic
3 Security Initiatives; amending s. 943.0311,
4 F.S.; providing for security assessments of all
5 buildings, facilities, and structures owned or
6 occupied by state agencies, state universities,
7 and community colleges, by the employees and
8 within existing resources of such state
9 agencies, state universities, or community
10 colleges; requiring completion of initial
11 security assessments by a specified date;
12 providing for subsequent security assessments;
13 providing for reports; requiring the chief to
14 communicate to local governments and water
15 management districts regarding security
16 assessments of buildings and facilities;
17 providing that costs of security assessments of
18 local government buildings and facilities shall
19 be borne by the local government or water
20 management district; authorizing the chief to
21 communicate certain information concerning
22 security assessments to private entities;
23 requiring that the costs of such assessments be
24 borne by the private entities; defining the
25 term "state agency" for purposes of the act;
26 providing an effective date.

28 Be It Enacted by the Legislature of the State of Florida:
29
30 Section 1. Section 943.0311, Florida Statutes, is
31 amended to read:

2 the department's duties of the department with respect to
3 domestic security.--
4 (1) The executive director of the department, or a
5 member of the department designated by the executive director,
6 shall serve as the Chief of Domestic Security Initiatives.
7 (1) The Chief of Domestic Security Initiatives shall:
8 (a) Coordinate the efforts of the department in the
9 ongoing assessment of this state's vulnerability to, and
10 ability to detect and respond to, acts of terrorism, as
11 defined in s. 775.30, within or affecting this state.
12 (b) Prepare recommendations for the Executive Office
13 of the Governor, the President of the Senate, and the Speaker
14 of the House of Representatives, which are based upon ongoing
15 assessments to limit the vulnerability of the state to
16 terrorism.
17 (c) Coordinate the collection of proposals to limit
18 the vulnerability of the state to terrorism.
19 (d) Use regional task forces to support the duties of
20 the department set forth in this section.
21 (e) Use public or private resources to perform the
22 duties assigned to the department under this section.
23 (f) Perform other duties assigned by law.
24 (2)(a) The chief shall conduct or cause to be
25 conducted by the personnel and with the resources of the state
26 agency, state university, or community college that owns or
27 leases a building, facility, or structure, specific security
28 assessments of buildings, and facilities, and structures owned
29 or leased by state agencies, state universities, and community
30 colleges. Each state agency, state university, and community
31 college or local governments. All state agencies and local

1 governments shall cooperate with the department and provide
2 the assistance of employees within existing resources to
3 provide to the chief information in the format requested by
4 the chief. The chief must report to the Governor, the
5 President of the Senate, and the Speaker of the House of
6 Representatives if any state agency, state university, or
7 community college substantially fails to cooperate with the
8 chief in making a security assessment of the buildings,
9 facilities, and structures of the state agency, state
10 university, or community college.
11 (a) The initial assessment of each building, facility,
12 or structure owned or leased by a state agency, state
13 university, or community college shall be completed by the
14 state agency, state university, or community college and shall
15 be provided to the chief no later than November 1, 2004.
16 (b) The chief may request followup assessments to
17 ensure that the security assessments of buildings, facilities,
18 and structures, owned or leased by state agencies, state
19 universities, and community colleges, remain reasonably
20 current and valid. requested information and resources to
21 assist the department in meeting its responsibilities under
22 this section.
23 (b) Based upon the security assessments, the chief
24 shall prepare recommendations to enhance the security of
25 buildings and facilities owned or leased by state agencies or
26 local governments.
27 (3)(c) The chief shall report to the Executive Office
28 of the Governor, the President of the Senate, and the Speaker
29 of the House of Representatives by November 1 of each year
30 prioritized suggestions for specific security enhancement of
31 recommended minimum security standards or security-enhancement

1 needs for any building, or facility, or structure owned or
2 leased by a state agency, state university, or community
3 college or any entity that has conducted an assessment under
4 subsection (5) or local government. The report must identify
5 and prioritize the recommended security enhancements and
6 provide recommendations to maximize federal funding in support
7 of building and facility security.
8 (4)(3) The chief shall report develop and submit to
9 the Executive Office of the Governor, the President of the
10 Senate, and the Speaker of the House of Representatives
11 recommended best practices for safety and security of
12 buildings, facilities, and structures owned or leased by state
13 agencies, state universities, community colleges, and local
14 governments. To promote the continued safety of government
15 buildings, facilities, and structures within the state, the
16 best practices may be revised or enhanced by the chief as
17 necessary. The recommended best practices are not a rule as
18 defined in chapter 120.
19 (5) The chief shall communicate to local governments
20 and water management districts the importance of conducting
21 security assessments of buildings, facilities, and structures
22 owned or leased by such local governments or water management
23 districts, and the options local governments and water
24 management districts should consider in obtaining security
25 assessments. The cost of any security assessment of a
26 building, facility, or structure owned or leased by a local
27 government or water management district shall be borne by the
28 local government or water management district, as applicable.
29 The chief shall review the recommended best practices as
30 necessary, but at least once each year, and shall submit any
31 recommended changes to the Executive Office of the Governor,

1 the President of the Senate, and the Speaker of the House of
2 Representatives.
3 (6)(4) The chief may communicate to private entities
4 the options private entities should consider in obtaining
5 security assessments and may solicit private entities for the
6 purpose of communicating such options. The cost of any
7 security assessment of a private entity shall be borne by the
8 private entity. conduct specific security assessments of a
9 building or facility owned by a private entity upon the
10 request of that private entity. The chief may prioritize
11 requests, and such prioritization is not agency action that is
12 subject to review under chapter 120. The chief may solicit
13 private entities for the purpose of receiving requests to
14 perform security assessments of buildings or facilities.
15 Private entities are urged to cooperate with and assist the
16 department in meeting its responsibilities for domestic
17 security.
18 (7) As used in this section, the term "state agency"
19 includes the Agency for Health Care Administration, the Agency
20 for Workforce Innovation, the Department of Agriculture and
21 Consumer Services, the Department of Business and Professional
22 Regulation, the Department of Children and Family Services,
23 the Department of Citrus, the Department of Community Affairs,
24 the Department of Corrections, the Department of Education,
25 the Department of Elderly Affairs, the Department of
26 Environmental Protection, the Department of Financial
27 Services, the Department of Health, the Department of Highway
28 Safety and Motor Vehicles, the Department of Juvenile Justice,
29 the Department of Law Enforcement, the Department of Legal
30 Affairs, the Department of Management Services, the Department
31 of Military Affairs, the Department of Revenue, the Department

1 of State, the Department of the Lottery, the Department of
2 Transportation, the Department of Veterans' Affairs, the Fish
3 and Wildlife Conservation Commission, the Parole Commission,
4 the State Board of Administration, and the Executive Office of
5 the Governor.
6 (5) By November 1 of each year, the executive director
7 shall compile, coordinate, and prioritize recommendations and
8 proposals concerning security and shall present the
9 recommendations and proposals to the Executive Office of the
10 Governor, the President of the Senate, and the Speaker of the
11 House of Representatives. All recommendations seeking funding
12 shall be prioritized, with critical domestic security needs
13 requiring immediate or top-priority funding being clearly
14 identified. Such recommendations shall include recommendations
15 to maximize federal funding in support of the state's
16 domestic-security efforts.
17 Section 2. This act shall take effect upon becoming a
18 law.
