  2         An act relating to trust funds; terminating and

  3         re-creating the Rape Crisis Program Trust Fund

  4         within the Department of Health without

  5         modification; carrying forward current balances

  6         and continuing current sources and uses

  7         thereof; repealing s. 794.056(3), F.S.;

  8         abrogating provisions relating to the

  9         termination of the trust fund, to conform;

10         providing an effective date.

12         WHEREAS, the Legislature wishes to extend the life of

13  the Rape Crisis Program Trust Fund within the Department of

14  Health, which is otherwise scheduled to be terminated pursuant

15  to constitutional mandate, and

16         WHEREAS, the Legislature has reviewed the trust fund

17  before its scheduled termination date and has found that it

18  continues to meet an important public purpose, and

19         WHEREAS, the Legislature has found that existing public

20  policy concerning the trust fund sets adequate parameters for

21  its use, NOW, THEREFORE,

23  Be It Enacted by the Legislature of the State of Florida:

24  

25         Section 1.  (1)  The Rape Crisis Program Trust Fund

26  within the Department of Health, FLAIR number 64-2-089, which

27  is to be terminated pursuant to Section 19(f), Article III of

28  the State Constitution on July 1, 2007, unless terminated

29  sooner by law, is terminated on November 4, 2004, and

30  re-created.

 1         (2)  All current balances of the trust fund are carried

 2  forward, and all current sources and uses of the trust fund

 3  are continued.

 4         Section 2.  Subsection (3) of section 794.056, Florida

 5  Statutes, as created by section 1 of chapter 2003-140, Laws of

 6  Florida, is repealed.

 7         Section 3.  This act shall take effect November 4,

 8  2004.
