  1                      A bill to be entitled

  2         An act relating to trust funds; terminating and

  3         re-creating the Florida Center for Nursing

  4         Trust Fund within the Department of Health

  5         without modification; carrying forward current

  6         balances and continuing current sources and

  7         uses thereof; repealing s. 464.0198(3), F.S.;

  8         abrogating provisions relating to the

  9         termination of the trust fund, to conform;

10         providing an effective date.

12         WHEREAS, the Legislature wishes to extend the life of

13  the Florida Center for Nursing Trust Fund within the

14  Department of Health, which is otherwise scheduled to be

15  terminated pursuant to constitutional mandate, and

16         WHEREAS, the Legislature has reviewed the trust fund

17  before its scheduled termination date and has found that it

18  continues to meet an important public purpose, and

19         WHEREAS, the Legislature has found that existing public

20  policy concerning the trust fund sets adequate parameters for

21  its use, NOW, THEREFORE,

23  Be It Enacted by the Legislature of the State of Florida:

24  

25         Section 1.  (1)  The Florida Center for Nursing Trust

26  Fund within the Department of Health, FLAIR number 64-2-283,

27  which is to be terminated pursuant to Section 19(f), Article

28  III of the State Constitution on July 1, 2006, unless

29  terminated sooner by law, is terminated on November 4, 2004,

30  and re-created.

 1         (2)  All current balances of the trust fund are carried

 2  forward, and all current sources and uses of the trust fund

 3  are continued.

 4         Section 2.  Subsection (3) of section 464.0198, Florida

 5  Statutes, is repealed.

 6         Section 3.  This act shall take effect November 4,

 7  2004.

10                          SENATE SUMMARY

11    Terminates and re-creates the Florida Center for Nursing
      Trust Fund within the Department of Health in order to
12    synchronize its review cycle with other trust funds of
      the department.
