| 6 | Statutes, is reenacted to read: |
| 7 | 110.12315 Prescription drug program.--The state employees' |
| 8 | prescription drug program is established. This program shall be |
| 9 | administered by the Department of Management Services, according |
| 10 | to the terms and conditions of the plan as established by the |
| 11 | relevant provisions of the annual General Appropriations Act and |
| 12 | implementing legislation, subject to the following conditions: |
| 13 | (7) Under the state employees' prescription drug program |
| 14 | copayments must be made as follows: |
| 15 | (a) Effective January 1, 2001, through December 31, 2003: |
| 16 | 1. For generic drug with card....$7. |
| 17 | 2. For preferred brand name drug with card....$20. |
| 18 | 3. For nonpreferred brand name drug with card....$35. |
| 19 | 4. For generic mail order drug....$10.50. |
| 20 | 5. For preferred brand name mail order drug....$30. |
| 21 | 6. For nonpreferred brand name drug....$52.50. |
| 22 | (b) Effective January 1, 2004: |
| 23 | 1. For generic drug with card....$10. |
| 24 | 2. For preferred brand name drug with card....$25. |
| 25 | 3. For nonpreferred brand name drug with card....$40. |
| 26 | 4. For generic mail order drug....$20. |
| 27 | 5. For preferred brand name mail order drug....$50. |
| 28 | 6. For nonpreferred brand name drug....$80. |
| 29 | (c) The Department of Management Services shall create a |
| 30 | preferred brand name drug list to be used in the administration |
| 31 | of the state employees' prescription drug program. |

| 33 | This subsection expires July 1, 2004. |
| 34 | Section 2. Section 110.1239, Florida Statutes, is |
| 35 | reenacted to read: |
| 36 | 110.1239 State group health insurance program funding.-- |
| 37 | For the 2003-2004 fiscal year only, it is the intent of the |
| 38 | Legislature that the state group health insurance program be |
| 39 | managed, administered, operated, and funded in such a manner as |
| 40 | to maximize the protection of state employee health insurance |
| 41 | benefits. Inherent in this intent is the recognition that the |
| 42 | health insurance liabilities attributable to the benefits |
| 43 | offered state employees should be fairly, orderly, and equitably |
| 44 | funded. Accordingly: |
| 45 | (1) The division shall determine the level of premiums |
| 46 | necessary to fully fund the state group health insurance program |
| 47 | for the next fiscal year. Such determination shall be made after |
| 48 | each Self-Insurance Estimating Conference as provided in s. |
| 49 | 216.136(11), but not later than December 1 and April 1 of each |
| 50 | fiscal year. |
| 51 | (2) The Governor, in the Governor's recommended budget, |
| 52 | shall provide premium rates necessary for full funding of the |
| 53 | state group health insurance program, and the Legislature shall |
| 54 | provide in the General Appropriations Act for a premium level |
| 55 | necessary for full funding of the state group health insurance |
| 56 | program. |
| 57 | (3) For purposes of funding, any additional appropriation |
| 58 | amounts allocated to the state group health insurance program by |
| 59 | the Legislature shall be considered as a state contribution and |
| 60 | thus an increase in the state premiums. |
| 61 | (4) This section expires July 1, 2004. |
| 62 | Section 3. Subsection (3) of section 624.437, Florida |
| 63 | Statutes, is reenacted to read: |
| 64 | 624.437 "Multiple-employer welfare arrangement" defined; |
| 65 | certificate of authority required; penalty.-- |
| 66 | (3) This section does not apply to a multiple-employer |
| 67 | welfare arrangement which offers or provides benefits which are |
| 68 | fully insured by an authorized insurer or to an arrangement |
| 69 | which is exempt from state insurance regulation in accordance |
| 70 | with Pub. L. No. 93-406, the Employee Retirement Income Security |
| 71 | Act. |
| 72 | Section 4. This act shall take effect upon becoming a law. |
