| 6 | 23. For Tier One or Tier Two employers which employ no |

| 8 | the minimum wage hourly rate for one full-time employee for 1 |
| 9 | year at 40 hours per week, the plan shall establish actuarially |
| 10 | sound premiums, provided, however, that the premiums may not |
| 11 | exceed $2,500. These premiums shall be in addition to the fee |
| 12 | specified in subparagraph 26. When the plan establishes |
| 13 | actuarially sound rates for all employers in Tier One and Tier |
| 14 | Two, the premiums for employers referred to in this paragraph |
| 15 | are no longer subject to the $2,500 cap. |
