6An act relating to specialty license plates; amending ss.
7320.08056 and 320.08058, F.S.; creating the Kids Deserve
8Justice license plate; providing for an annual use fee;
9providing for the distribution of such fees received from
10the sale of the plates; providing an effective date.

12     WHEREAS, many of Florida's children require special
13protection and assistance in order to become self-sufficient
14adults and contributing members of society, and
15     WHEREAS, low-income children often lack access to legal
16services advocacy and other support services they need to
17achieve their full potential, and
18     WHEREAS, there are inadequate resources available to
19support legal services advocacy, NOW, THEREFORE,
20
21Be It Enacted by the Legislature of the State of Florida:
22
23     Section 1.  Paragraph (ss) is added to subsection (4) of
24section 320.08056, Florida Statutes, to read:
25     320.08056  Specialty license plates.--
26     (4)  The following license plate annual use fees shall be
27collected for the appropriate specialty license plates:
28     (ss)  Kids Deserve Justice license plate, $25.
29     Section 2.  Subsection (45) is added to section 320.08058,
30Florida Statutes, to read:
31     320.08058  Specialty license plates.--
32     (45)  KIDS DESERVE JUSTICE LICENSE PLATES.--
33     (a)  The department shall develop a Kids Deserve Justice
34license plate as provided in this section. Kids Deserve Justice
35license plates must bear the colors and design approved by the
36department. The word "Florida" must appear at the top of the
37plate, and the words "Kids Deserve Justice" must appear at the
38bottom of the plate.
39     (b)  The requirements of s. 320.08053 must be met prior to
40the issuance of the plate. Thereafter, the department shall
41remit the proceeds of the annual use fees to the Florida Bar
42Foundation, Inc. The Florida Bar Foundation, Inc., shall retain
43all revenues from the sale of such plates so that all startup
44costs for developing and establishing the plate may be recovered
45by The Florida Bar and the Florida Bar Foundation, Inc. All
46remaining funds thereafter shall be expended by the Florida Bar
47Foundation, Inc., which shall provide for a grant solicitation
48and award process to distribute funds from the fees to
49children's legal services programs, which shall include, without
50limitation, legal services advocacy for disabled children to
51secure needed federal benefits for their well-being, for
52learning-disabled children to secure testing and services
53required by law, or for legal representation of abused and
54neglected children to promptly achieve permanent placement. The
55Florida Bar Foundation, Inc., shall award grants for children's
56legal services on statewide and local levels.
57     Section 3.  This act shall take effect July 1, 2004.
