| 6 | Statutes, is reenacted to read: |
| 7 | 17.41 Department of Financial Services Tobacco Settlement |
| 8 | Clearing Trust Fund.-- |
| 9 | (5) The department shall disburse funds, by nonoperating |
| 10 | transfer, from the Tobacco Settlement Clearing Trust Fund to the |
| 11 | tobacco settlement trust funds of the various agencies in |
| 12 | amounts equal to the annual appropriations made from those |
| 13 | agencies' trust funds in the General Appropriations Act. |
| 14 | Section 2. Paragraph (h) of subsection (1) of section |
| 15 | 20.435, Florida Statutes, as amended by section 2 of chapter |
| 16 | 2003-421, Laws of Florida, is reenacted to read: |
| 17 | 20.435 Department of Health; trust funds.-- |
| 18 | (1) The following trust funds are hereby created, to be |
| 19 | administered by the Department of Health: |
| 20 | (h) Biomedical Research Trust Fund. |
| 21 | 1. Funds to be credited to the trust fund shall consist of |
| 22 | funds deposited pursuant to s. 215.5601. Funds shall be used for |
| 23 | the purposes of the James and Esther King Biomedical Research |
| 24 | Program as specified in ss. 215.5602 and 288.955. The trust fund |
| 25 | is exempt from the service charges imposed by s. 215.20. |
| 26 | 2. Notwithstanding the provisions of s. 216.301 and |
| 27 | pursuant to s. 216.351, any balance in the trust fund at the end |
| 28 | of any fiscal year shall remain in the trust fund at the end of |
| 29 | the year and shall be available for carrying out the purposes of |
| 30 | the trust fund. |
| 31 | 3. The trust fund shall, unless terminated sooner, be |
| 32 | terminated on July 1, 2008. |
| 33 | Section 3. Paragraph (e) of subsection (5) of section |
| 34 | 215.5601, Florida Statutes, is reenacted to read: |
| 35 | 215.5601 Lawton Chiles Endowment Fund.-- |
| 36 | (5) AVAILABILITY OF FUNDS; USES.-- |
| 37 | (e) Notwithstanding s. 216.301 and pursuant to s. 216.351, |
| 38 | all unencumbered balances of appropriations as of June 30 or |
| 39 | undisbursed balances as of December 31 shall revert to the |
| 40 | endowment's principal. Unencumbered or undisbursed balances |
| 41 | appropriated for biomedical research shall revert to the |
| 42 | principal in the separately reserved and accounted-for portion |
| 43 | of the endowment established for biomedical research activities. |
| 44 | Section 4. This act shall take effect July 1, 2004. |
