11  Senator Peaden moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 33, line 3, after the period
15  
16  insert:  
17         (3)  A provider of services rendered to persons with
18  developmental disabilities pursuant to a federally approved
19  waiver shall be reimbursed according to a rate methodology
20  based on an analysis of the expenditure history and
21  prospective costs of providers participating in the waiver
22  program, or under any other methodology developed by the
23  Agency for Health Care Administration, in consultation with
24  the Agency for Persons with Disabilities, and approved by the
25  federal government in accordance with the waiver.
26         (4)  Pending the adoption of rate methodologies by
27  non-emergency rulemaking pursuant to s. 120.54, the Agency for
28  Health Care Administration may at any time adopt emergency
29  rules pursuant to s. 120.54(4) in order to comply with
30  subsection (5). In adopting such emergency rules, the agency
31  need not make the findings required by s. 120.54(4)(a), and

SENATE AMENDMENT Bill No. CS for CS for SB 1280 Amendment No. ___ Barcode 700986 1 such rules shall be exempt from time limitations provided in 2 s. 120.54(4)(c) and remain in effect until replaced by another 3 emergency rule or the non-emergency adoption of the rate 4 methodology. 5 (5) Nothing in this section or rule shall be construed 6 to prevent or limit the Agency for Health Care Administration, 7 in consultation with the Agency for Persons with Disabilities, 8 from adjusting fees, limiting enrollment, reimbursement rates, 9 lengths of stay, number of visits, number of services, or 10 making any other adjustment necessary to comply with the 11 availability of moneys and any limitations or directions 12 provided for in the General Appropriations Act. If at any 13 time based upon an analysis by the Agency for Health Care 14 Administration, in consultation with the Agency for Persons 15 with Disabilities, the cost of Home and Community-Based waiver 16 services are expected to exceed the appropriated amount, the 17 Agency for Health Care Administration may implement any 18 adjustment, including provider rate reductions, within 30 days 19 in order to remain within the appropriation. 20 21 22 ================ T I T L E A M E N D M E N T =============== 23 And the title is amended as follows: 24 On page 2, line 7, after the first semicolon, 25 26 insert: 27 authorizing the Agency for Disabled Persons to 28 enter into certain contracts; providing for 29 reimbursement to certain providers of services 30 to the developmentally disabled pursuant to a 31 methodology; requiring the Agency for Health 2 11:40 PM 04/26/04 s1280.cf02.ad
