3 and related services payments; amending s.
4 409.904, F.S.; providing for Medicaid
5 eligibility for certain disabled persons under
6 a Medicaid buy-in program, subject to specific
7 federal authorization; providing an effective
8 date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (11) is added to section
13 409.904, Florida Statutes, to read:
14 409.904 Optional payments for eligible persons.--The
15 agency may make payments for medical assistance and related
16 services on behalf of the following persons who are determined
17 to be eligible subject to the income, assets, and categorical
18 eligibility tests set forth in federal and state law. Payment
19 on behalf of these Medicaid eligible persons is subject to the
20 availability of moneys and any limitations established by the
21 General Appropriations Act or chapter 216.
22 (11) Subject to specific federal authorization, a
23 person who, but for earnings in excess of the limit
24 established under s. 1905(q)(2)(B) of the Social Security Act,
25 would be considered for receiving supplemental security
26 income; who is at least 16 but less than 65 years of age; and
27 whose assets, resources, and earned and unearned income do not
28 exceed 250 percent of the most current federal poverty level.
29 Such persons may be eligible for Medicaid services as part of
30 a Medicaid buy-in established under s. 409.914(2) specifically
31 designed to accommodate those persons made eligible for such a

1 buy-in by Title II of Pub. L. No. 106-170. Such buy-in must
2 include income-related premiums and cost sharing.
3 Section 2. This act shall take effect July 1, 2004.
