11  Senator Fasano moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 5, lines 3-8, delete those lines
15  
16  and insert:  
17         (7)  A community pharmacy licensed under this chapter
18  which only receives and transfers prescriptions for dispensing
19  by another pharmacy may transfer a prescription for a
20  medicinal drug listed in Schedule II under chapter 893. The
21  pharmacy receiving the prescription may ship, mail, or deliver
22  into this state, in any manner, the dispensed Schedule II
23  medicinal drug under the following conditions:
24         (a)  The pharmacy receiving and dispensing the
25  transferred prescription maintains at all times a valid,
26  unexpired license, permit, or registration to operate the
27  pharmacy in compliance with the laws of the state in which the
28  pharmacy is located and from which the medicinal drugs are
29  dispensed;
30         (b)  The community pharmacy and the receiving pharmacy
31  are owned and operated by the same person and share a

 2         (c)  The community pharmacy assures its compliance with
 3  the federal laws and subsections (1)-(5).

 9            page 2, line 3, delete those lines

12         465.026, F.S.; authorizing a community pharmacy

15         providing an effective date.
