1 A bill to be entitled
2 An act relating to automated pharmacy systems;
3 amending s. 465.003, F.S.; defining the term
4 "automated pharmacy system" for purposes of the
5 Florida Pharmacy Act; creating s. 465.0235,
6 F.S.; authorizing a pharmacy to provide
7 services to a long-term care facility licensed
8 under ch. 400, F.S., or a state correctional
9 institution operated under ch. 944, F.S.,
10 through an automated pharmacy system; providing
11 that drugs dispensed from an automated pharmacy
12 system are considered to have been dispensed by
13 the pharmacy that services a long-term care
14 facility or correctional institution; requiring
15 that the operation of an automated pharmacy
16 system be under the supervision of a
17 pharmacist; requiring the Board of Pharmacy to
18 adopt rules; providing an effective date.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Subsection (17) is added to section
23 465.003, Florida Statutes, to read:
24 465.003 Definitions.--As used in this chapter, the
25 term:
26 (17) "Automated pharmacy system" means a mechanical
27 system that dispenses prescription drugs and maintains related
28 transaction information.
29 Section 2. Section 465.0235, Florida Statutes, is
30 created to read:

1 465.0235 Automated pharmacy systems used by long-term
2 care facilities or state correctional institutions.--
3 (1) A pharmacy may provide pharmacy services to a
4 long-term care facility licensed under chapter 400 or a state
5 correctional institution operated under chapter 944 through
6 the use of an automated pharmacy system that need not be
7 located at the same location as the pharmacy.
8 (2) Medicinal drugs stored in bulk or unit of use in
9 an automated pharmacy system servicing a long-term care
10 facility or correctional institution are part of the inventory
11 of the pharmacy providing pharmacy services to that facility
12 or institution, and drugs dispensed from the automated
13 pharmacy system are considered to have been dispensed by that
14 pharmacy.
15 (3) The operation of an automated pharmacy system must
16 be under the supervision of a licensed pharmacist. To qualify
17 as a supervisor for an automated pharmacy system, the
18 pharmacist need not be physically present at the site of the
19 automated pharmacy system and may supervise the system
20 electronically.
21 (4) The board shall adopt rules governing the use of
22 an automated pharmacy system by January 1, 2005, which must
23 specify:
24 (a) Recordkeeping requirements;
25 (b) Security requirements; and
26 (c) Labeling requirements that permit the use of
27 unit-dose medications if the facility or institution maintains
28 medication-administration records that include directions for
29 use of the medication and the automated pharmacy system
30 identifies:
31 1. The dispensing pharmacy;

1 2. The prescription number;
2 3. The name of the patient; and
3 4. The name of the prescribing practitioner.
4 Section 3. This act shall take effect upon becoming a
5 law.

8 SENATE SUMMARY
9 Defines the term "automated pharmacy system." Provides
for a pharmacy to provide services to a long-term care
10 facility or a state correctional institution through an
automated pharmacy system in a facility that need not be
11 located at the pharmacy. Provides that drugs dispensed
from an automated pharmacy system are considered to have
12 been dispensed by the pharmacy servicing the long-term
care facility or correctional institution. Requires that
13 the operation of an automated pharmacy system be
supervised by a pharmacist. Provides rulemaking authority
14 of the Board of Pharmacy.
