A bill to be entitled
6An act relating to alcoholic beverage licenses; amending
7s. 565.02, F.S.; authorizing the issuance of a non-quota
8license to certain sporting and recreational lodges;
9requiring that serving hours conform to certain local
10ordinances; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Present subsection (12) of section 565.02,
15Florida Statutes, is redesignated as subsection (13), and a new
16subsection (12) is added to that section to read:
17     565.02  License fees; vendors; clubs; caterers; and
18others.--
19     (12)  A sporting and recreational lodge complex may obtain,
20upon the payment of appropriate fees, a license for on-premises
21consumption of alcoholic beverages not subject to any quota or
22limitation if the complex:
23     (a)  Comprises at least 10,000 acres of land.
24     (b)  Has indoor sleeping facilities with at least 12 rooms.
25     (c)  Has a restaurant that seats at least 25 persons.
26     (d)  Has been in continuous existence for at least 2 years.

28The enclosed area within the complex shall be considered the
29licensed premises upon the payment of the fee. Except as
30otherwise provided in this subsection, entities licensed under
31this subsection shall be treated as vendors licensed to sell
32alcoholic beverages by the drink and shall be subject to all the
33provisions relating to such vendors. However, notwithstanding
34any provision of law, such complex shall only sell or provide
35alcoholic beverages in a manner that is consistent with any
36local ordinance of a governing body having jurisdiction over the
37location of the complex.
38     Section 2.  This act shall take effect July 1, 2004.
