1 A bill to be entitled
2 An act relating to construction practices;
3 requiring the Florida Building Commission to
4 review construction practices and building
5 inspections in this state and to make
6 recommendations for the improvement of those
7 practices and inspections; providing procedures
8 for the review; requiring the commission to
9 report to the Governor and legislative leaders;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Florida Building Commission review of
15 construction practices and inspections.--
16 (1) LEGISLATIVE FINDINGS AND INTENT.--The Legislature
17 finds that due to the rapidly increasing rate of construction
18 which has occurred in the first few years of the 21st century,
19 the possibility exists for an increase in the prevalence of
20 construction flaws and for a decrease in the quality of
21 building and home inspections. The intent of the Legislature
22 is that the review initiated under this act will produce
23 findings that will increase the quality of construction and
24 optimize the effectiveness of home inspections, while
25 promoting the safety, accountability, and affordability of
26 construction in this state.
27 (2) REVIEW PROCEDURES.--Beginning July 1, 2004, the
28 Florida Building Commission shall conduct a review of current
29 construction practices in this state for the purpose of
30 formulating recommendations concerning how to improve the
31 quality of construction in the state and how to maximize the

1 effectiveness of the building inspections and home inspections
2 associated with such construction. The commission shall
3 conduct or contract for research that supports this purpose
4 and shall conduct hearings and any other activities that the
5 commission considers essential in fulfilling this purpose.
6 (3) REPORT.--By January 15, 2005, the Florida Building
7 Commission shall write a report of its findings under this
8 section and shall submit copies of the report to the Governor,
9 the President of the Senate, and the Speaker of the House of
10 Representatives. The report must include any recommendations
11 for proposed legislation that the commission considers
12 appropriate and necessary.
13 Section 2. This act shall take effect July 1, 2004.
