1 A bill to be entitled
2 An act relating to private passenger motor
3 vehicle insurance; requiring an employee or
4 agent of an insurer to provide certain
5 disclosures prior to the sale of such
6 insurance; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. An employee or agent of an insurer, before
11 accepting an application for private passenger motor vehicle
12 insurance, must:
13 (1) Give the applicant a written disclosure statement
14 that;
15 (a) Describes in plain language the types and amounts
16 of coverages that are available in this state, including
17 bodily injury liability, personal injury protection, property
18 damage liability, medical payments, uninsured and underinsured
19 motorist, collision, and comprehensive coverages; and
20 (b) States which types and amounts of coverage are
21 provided in the proposed policy;
22 (2) Explain such coverages to the applicant and answer
23 any questions from the applicant;
24 (3) Have the applicant initial the description of each
25 coverage and sign the disclosure statement acknowledging that
26 the employee or agent explained the coverages and that the
27 applicant understands them; and
28 (4) Provide a copy of the signed disclosure statement
29 to the applicant.
30 Section 2. This act shall take effect July 1, 2004.

available coverages and coverages selected be given to an

5 application. Establishes disclosure requirements.
