1 A bill to be entitled
2 An act relating to mobile home parks; amending
3 s. 723.0612, F.S.; revising provisions for
4 payment by the park owner to the Florida Mobile
5 Home Relocation Corporation when the mobile
6 home owner chooses to abandon the mobile home
7 rather than relocate due to a change in use of
8 the mobile home park; providing an effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (7) of section 723.0612, Florida
14 Statutes, is amended to read:
15 723.0612 Change in use; relocation expenses; payments
16 by park owner.--
17 (7) In lieu of collecting payment from the Florida
18 Mobile Home Relocation Corporation as set forth in subsection
19 (1), a mobile home owner may abandon the mobile home in the
20 mobile home park and collect $1,375 for a single section and
21 $2,750 for a multisection from the corporation as long as the
22 mobile home owner delivers to the park owner the current title
23 to the mobile home duly endorsed by the owner of record and
24 valid releases of all liens shown on the title. If a mobile
25 home owner chooses this option, the park owner shall make
26 payment to the corporation in an amount equal to the amount
27 the mobile home owner is entitled to under this subsection
28 one-fourth of the maximum allowable moving expenses. The
29 mobile home owner's application for funds under this
30 subsection shall require the submission of a document signed
31 by the park owner stating that the home has been abandoned

1 under this subsection and that the park owner agrees to make
2 payment to the corporation in the amount provided to the home
3 owner under this subsection section. However, in the event
4 that the required documents are not submitted with the
5 application, the corporation may consider the facts and
6 circumstances surrounding the abandonment of the home to
7 determine whether the mobile home owner is entitled to payment
8 under pursuant to this subsection section.
9 Section 2. This act shall take effect upon becoming a
10 law.

15 The committee substitute clarifies that mobile home park
owners are required to pay into the Florida Mobile Home
16 Relocation Trust Fund when the mobile home owner chooses to
abandon the home rather than relocate.
