2 An act relating to the Elevator Safety
3 Technical Advisory Council; creating s.
4 399.1061, F.S.; creating the council within the
5 Division of Hotels and Restaurants of the
6 Department of Business and Professional
7 Regulation; providing for the membership of the
8 council; requiring the council to provide
9 technical assistance to the division; providing
10 for appointments and terms of office; providing
11 for payment of per diem and travel expenses;
12 repealing s. 399.106, F.S., relating to the
13 former Elevator Safety Technical Advisory
14 Committee; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Section 399.1061, Florida Statutes, is
19 created to read:
20 399.1061 Elevator Safety Technical Advisory Council.--
21 (1) The Elevator Safety Technical Advisory Council is
22 created within the division and shall consist of eight
23 members, appointed by the secretary of the department, who
24 meet the following criteria: one representative from a major
25 elevator manufacturing company or its authorized
26 representative; one representative from an elevator servicing
27 company; one representative from a building design profession;
28 one representative of the general public; one representative
29 of a local government in this state; one representative of a
30 building owner or manager; one representative of labor
31 involved in the installation, maintenance, and repair of

1 elevators; and one representative who is a certified elevator
2 inspector from a private inspection service. The council shall
3 provide technical assistance to the division in support of
4 protecting the health, safety, and welfare of the public and
5 shall give the division the benefit of the council members'
6 knowledge and experience concerning the industries and
7 individual businesses affected by the laws and rules
8 administered by the division.
9 (2)(a) The council members shall be appointed to
10 4-year terms, except that to provide for staggered terms four
11 of the initial appointees, as specified by rule, shall be
12 appointed to 2-year terms. All subsequent appointments shall
13 be 4-year terms. The council shall appoint one of the members
14 to serve as chair.
15 (b) The council members shall serve without
16 compensation, except the members may be reimbursed for per
17 diem and travel expenses as provided in s. 112.061.
18 (3) The council may consult with engineering
19 authorities and organizations concerned with standard safety
20 codes for recommendations to the department regarding rules
21 governing the operation, maintenance, servicing, construction,
22 alteration, installation, or inspection of vertical
23 conveyances subject to this chapter.
24 Section 2. Section 399.106, Florida Statutes, is
25 repealed.
26 Section 3. This act shall take effect upon becoming a
27 law.

definitions in s. 20.03, F.S. Provides for initial two-year
5 terms to permit staggering of terms. Removes bill's provisions
regarding reappointment.
