  1                      A bill to be entitled

  2         An act relating to construction contracting;

  3         amending s. 489.117, F.S.; specifying

  4         conditions under which a person may perform

  5         specialty contracting services for the

  6         construction, remodeling, repair, or

  7         improvement of a swimming pool or spa without

  8         obtaining a local professional license;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Paragraph (f) is added to subsection (4) of

14  section 489.117, Florida Statutes, to read:

15         489.117  Registration; specialty contractors.--

16         (4)

17         (f)  Any person who is not required to obtain

18  registration or certification pursuant to s. 489.105(3)(a)-(i)

19  or (m)-(o) may perform specialty contracting services for the

20  construction, remodeling, repair, or improvement of a swimming

21  pool or spa as specified in s. 489.105(3)(j)-(l) without

22  obtaining a local professional license if such person is under

23  the supervision of a certified or registered commercial

24  pool/spa contractor, residential pool/spa contractor, or

25  swimming pool/spa servicing contractor acting within the scope

26  of his or her license. As used in this paragraph, supervision

27  shall not be deemed to require the existence of a direct

28  contract between the certified or registered contractor and

29  the person performing specialty contracting services.

30         Section 2.  This act shall take effect July 1, 2004.
