A bill to be entitled
2An act relating to Escambia County; repealing chapter
32001-324, Laws of Florida, as amended; abolishing the
4Emerald Coast Utilities Authority and transferring all
5powers, duties, assets, and liabilities of the authority
6to the Emerald Coast Utilities Authority, a Charter
7Agency, created by the Charter for Escambia County;
8providing for employees of the authority to become
9employees of the Charter Agency; providing for referendum
10approval; providing a contingent effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Chapter 2001-324, Laws of Florida, as amended,
15is repealed.
16     Section 2.  On the effective date of this act, all powers,
17duties, assets, and liabilities of the Emerald Coast Utilities
18Authority are transferred to the Emerald Coast Utilities
19Authority, a Charter Agency, created by the Charter for Escambia
20County approved by a majority of the voters of Escambia County
21in a referendum election on March 9, 2004. On the effective date
22of this act, employees of the Emerald Coast Utilities Authority
23shall become employees of the Charter Agency.
24     Section 3.  This act shall take effect November 15, 2004,
25if HB 401 or similar legislation is adopted in the same
26legislative session or an extension thereof and becomes law, and
27if the Charter for Escambia County is approved by a majority of
28the voters of Escambia County in a referendum election on March
299, 2004.
