  1                      A bill to be entitled

  2         An act relating to engineering; amending s.

  3         471.031, F.S.; providing an exemption from a

  4         prohibition against unlicensed persons using

  5         the title "engineer"; providing limitations on

  6         such exemption; providing an effective date.

  7  

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Section 471.031, Florida Statutes, as

11  amended by section 3 of chapter 2003-425, Laws of Florida, is

12  amended to read:

13         471.031  Prohibitions; penalties.--

14         (1)  A person may not:

15         (a)  Practice engineering unless the person is licensed

16  or exempt from licensure under this chapter.

17         (b)1.  Except as provided in subparagraph 2., use the

18  name or title "professional engineer" or any other title,

19  designation, words, letters, abbreviations, or device tending

20  to indicate that such person holds an active license as an

21  engineer when the person is not licensed under this chapter,

22  including, but not limited to, the following titles:

23  "agricultural engineer," "air-conditioning engineer,"

24  "architectural engineer," "building engineer," "chemical

25  engineer," "civil engineer," "control systems engineer,"

26  "electrical engineer," "environmental engineer," "fire

27  protection engineer," "industrial engineer," "manufacturing

28  engineer," "mechanical engineer," "metallurgical engineer,"

29  "mining engineer," "minerals engineer," "marine engineer,"

30  "nuclear engineer," "petroleum engineer," "plumbing engineer,"

31  "structural engineer," "transportation engineer," "software

 1  engineer," "computer hardware engineer," or "systems

 2  engineer."

 3         2.  Any person who is exempt from licensure under s.

 4  471.003(2)(j) may use the title or personnel classification of

 5  "engineer" in the scope of his or her work under that

 6  exemption if the title does not include or connote the term

 7  "professional engineer," "registered engineer," "licensed

 8  engineer," "registered professional engineer," or "licensed

 9  professional engineer."

10         (c)  Present as his or her own the license of another.

11         (d)  Give false or forged evidence to the board or a

12  member thereof.

13         (e)  Use or attempt to use a license that has been

14  suspended, revoked, or placed on inactive or delinquent

15  status.

16         (f)  Employ nonexempt unlicensed persons to practice

17  engineering.

18         (g)  Conceal information relative to violations of this

19  chapter.

20         (2)  Notwithstanding paragraph (1)(a), a person who is

21  exempt from licensure under s. 471.003(2)(c) or (e) may use

22  the title or personnel classification of "engineer" in the

23  scope of his or her work under that exemption if the title

24  does not include or connote the term "professional engineer,"

25  "registered engineer," "licensed engineer," "registered

26  professional engineer," or "licensed professional engineer,"

27  and if that person is a graduate of an approved engineering

28  curriculum of 4 years or more in a school, college, or

29  university that has been approved by the board.

 1         (3)(2)  Any person who violates any provision of this

 2  section commits a misdemeanor of the first degree, punishable

 3  as provided in s. 775.082 or s. 775.083.

 4         Section 2.  This act shall take effect July 1, 2004.
