  1                      A bill to be entitled

  2         An act relating to victim assistance; amending

  3         s. 960.03, F.S., relating to the Florida Crimes

  4         Compensation Act; redefining the term "crime"

  5         to include any vehicular homicide as a crime

  6         that is compensable under the act; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Paragraph (b) of subsection (3) of section

12  960.03, Florida Statutes, is amended to read:

13         960.03  Definitions; ss. 960.01-960.28.--As used in ss.

14  960.01-960.28, unless the context otherwise requires, the

15  term:

16         (3)  "Crime" means:

17         (b)  A violation of s. 316.193, s. 316.027(1), s.

18  327.35(1), s. 782.071(1) s. 782.071(1)(b), or s. 860.13(1)(a)

19  which results in physical injury or death; however, no other

20  act involving the operation of a motor vehicle, boat, or

21  aircraft which results in injury or death shall constitute a

22  crime for the purpose of this chapter unless the injury or

23  death was intentionally inflicted through the use of such

24  vehicle, boat, or aircraft or unless such vehicle, boat, or

25  aircraft is an implement of a crime to which this act applies.

26         Section 2.  This act shall take effect July 1, 2004.

29                          SENATE SUMMARY

30    Revises the definition of the term "crime" under the
      Florida Crimes Compensation Act to provide that any
31    vehicular homicide is a crime for which compensation is
      paid pursuant to the act.
