A bill to be entitled
2An act relating to the City of North Lauderdale, Broward
3County; extending and enlarging the corporate limits of
4the City of North Lauderdale to include specified
5unincorporated lands within said corporate limits;
6providing for referendum; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:
9
10     Section 1.  The area known as the Commercial Boulevard
11annexation area is described as follows:
12PORTIONS OF SECTION 18, TOWNSHIP 49 SOUTH, RANGE 42 EAST
13BROWARD COUNTY FLORIDA; TOGETHER WITH ALL OF THE
14FOLLOWING PLATS RECORDED IN THE PUBLIC RECORDS OF BROWARD
15COUNTY, FLORIDA. DARGEL-MINNET PLAT, PLAT BOOK 104, PAGE
1616,"GUARDIAN PLAT", PLAT BOOK 111, PAGE 50, "TAMARAC MINI
17STORAGE PLAT No. 1" PLAT BOOK 112, PAGE 2, "THE POINT",

39462.40 FEET TO AN INTERSECTION WITH THE SOUTHERLY

43BEGINNING.
44SAID LANDS SITUATE IN BROWARD COUNTY, FLORIDA.
45     Section 2.  An election shall be scheduled by the Board of
46County Commissioners of Broward County in accordance with the
47provisions of law relating to elections currently in force in
48Broward County on November 2, 2004. Only registered voters
49residing in the Commercial Boulevard annexation area may vote in
50said election. A mail ballot may be used in said election. The
51item that shall appear on the ballot of the election of November
522, 2004, shall be as follows:
53Shall the Commercial Boulevard annexation area be annexed
54into the City of North Lauderdale effective September 15,
552005, or September 15, 2006?

59All of the Commercial Boulevard annexation area shall be
60annexed into the City of North Lauderdale effective
61September 15, 2005.

63All of the Commercial Boulevard annexation area shall be
64annexed into the City of North Lauderdale effective
65September 15, 2006.

67     Section 3.  All of the Commercial Boulevard annexation
68area, as defined herein, shall be deemed a part of the City of
69North Lauderdale effective on the date which receives a majority
70of the votes in the election described in section 2.
71     Section 4.  As of the effective date of annexation,
72whichever date receives a majority of the votes in the election
73described in section 2, the City of North Lauderdale shall have
74all powers and responsibilities as provided in section 171.062,
75Florida Statutes, except as provided in this act.
76     Section 5.  Upon annexation into the City of North
77Lauderdale, the following shall govern the areas described in
78the Commercial Boulevard annexation area as provided in this
79act: for any use, building, or structure that is legally in
80existence at the time the Commercial Boulevard annexation area
81becomes a part of the City of North Lauderdale, such use shall
82not be made a prohibited use by the City of North Lauderdale, on
83the property of said use, for as long as the use shall continue
84and is not voluntarily abandoned.
85     Section 6.  Subsequent to the effective date of this act,
86no change in land use designation or zoning shall be effective
87within the limits of the lands subject to annexation herein,
88until the Commercial Boulevard annexation area has been annexed
89into the City of North Lauderdale, pursuant to this act.
90     Section 7.  All public roads and the public rights-of-way
91associated therewith on the Broward County road system, lying
92within the limits of the lands subject to annexation herein, as
93described in section 1, are transferred from Broward County
94jurisdiction to the jurisdiction of the City of North
95Lauderdale, except for those portions of Commercial Boulevard
96lying within the annexation area. All rights, title, interests,
97and responsibilities for any transferred roads, including, but
98not limited to, the ownership, operation, maintenance, planning,
99design, and construction of said roads and to the right-of-way
100associated therewith shall transfer from the jurisdiction and
101ownership of Broward County to the jurisdiction and ownership of
102the City of North Lauderdale upon the effective date of the
103annexation.
104     Section 8.  Subsequent to the effective date of this
105annexation, any resident in the area to be annexed by this act
106into the City of North Lauderdale shall be deemed to have met
107any residency requirements for candidacy.
108     Section 9.  Upon the effective date of the annexation, the
109City of North Lauderdale shall be responsible for and embodied
110with all municipal powers granted in chapter 166, Florida
111Statutes, over territory hereby annexed.
112     Section 10.  Nothing in this chapter shall be construed to
113affect or abrogate the rights of parties to any contracts,
114whether the same be between Broward County and a third party or
115between nongovernmental entities, which contracts are in effect
116prior to the effective date of annexation.
117     Section 11.  This act shall take effect upon becoming law.
