8 | Be It Enacted by the Legislature of the State of Florida: |
9 |

10 | Section 1. The area known as the Commercial Boulevard |
11 | annexation area is described as follows: |
12 | PORTIONS OF SECTION 18, TOWNSHIP 49 SOUTH, RANGE 42 EAST |
13 | BROWARD COUNTY FLORIDA; TOGETHER WITH ALL OF THE |
14 | FOLLOWING PLATS RECORDED IN THE PUBLIC RECORDS OF BROWARD |

44 | SAID LANDS SITUATE IN BROWARD COUNTY, FLORIDA. |
45 | Section 2. An election shall be scheduled by the Board of |
46 | County Commissioners of Broward County in accordance with the |
47 | provisions of law relating to elections currently in force in |
48 | Broward County on November 2, 2004. Only registered voters |
49 | residing in the Commercial Boulevard annexation area may vote in |
50 | said election. A mail ballot may be used in said election. The |
51 | item that shall appear on the ballot of the election of November |
52 | 2, 2004, shall be as follows: |
53 | Shall the Commercial Boulevard annexation area be annexed |
54 | into the City of North Lauderdale effective September 15, |
55 | 2005, or September 15, 2006? |

59 | All of the Commercial Boulevard annexation area shall be |
60 | annexed into the City of North Lauderdale effective |
61 | September 15, 2005. |

63 | All of the Commercial Boulevard annexation area shall be |

65 | September 15, 2006. |

67 | Section 3. All of the Commercial Boulevard annexation |
68 | area, as defined herein, shall be deemed a part of the City of |
69 | North Lauderdale effective on the date which receives a majority |
70 | of the votes in the election described in section 2. |
71 | Section 4. As of the effective date of annexation, |
72 | whichever date receives a majority of the votes in the election |
73 | described in section 2, the City of North Lauderdale shall have |
74 | all powers and responsibilities as provided in section 171.062, |
75 | Florida Statutes, except as provided in this act. |
76 | Section 5. Upon annexation into the City of North |
77 | Lauderdale, the following shall govern the areas described in |
78 | the Commercial Boulevard annexation area as provided in this |
79 | act: for any use, building, or structure that is legally in |
80 | existence at the time the Commercial Boulevard annexation area |
81 | becomes a part of the City of North Lauderdale, such use shall |
82 | not be made a prohibited use by the City of North Lauderdale, on |
83 | the property of said use, for as long as the use shall continue |
84 | and is not voluntarily abandoned. |
85 | Section 6. Subsequent to the effective date of this act, |
86 | no change in land use designation or zoning shall be effective |
87 | within the limits of the lands subject to annexation herein, |
88 | until the Commercial Boulevard annexation area has been annexed |
89 | into the City of North Lauderdale, pursuant to this act. |
90 | Section 7. All public roads and the public rights-of-way |
91 | associated therewith on the Broward County road system, lying |
92 | within the limits of the lands subject to annexation herein, as |
93 | described in section 1, are transferred from Broward County |
94 | jurisdiction to the jurisdiction of the City of North |
95 | Lauderdale, except for those portions of Commercial Boulevard |
96 | lying within the annexation area. All rights, title, interests, |
97 | and responsibilities for any transferred roads, including, but |
98 | not limited to, the ownership, operation, maintenance, planning, |
99 | design, and construction of said roads and to the right-of-way |
100 | associated therewith shall transfer from the jurisdiction and |
101 | ownership of Broward County to the jurisdiction and ownership of |
102 | the City of North Lauderdale upon the effective date of the |
103 | annexation. |
104 | Section 8. Subsequent to the effective date of this |
105 | annexation, any resident in the area to be annexed by this act |
106 | into the City of North Lauderdale shall be deemed to have met |
107 | any residency requirements for candidacy. |
108 | Section 9. Upon the effective date of the annexation, the |
109 | City of North Lauderdale shall be responsible for and embodied |
110 | with all municipal powers granted in chapter 166, Florida |
111 | Statutes, over territory hereby annexed. |
112 | Section 10. Nothing in this chapter shall be construed to |
113 | affect or abrogate the rights of parties to any contracts, |
114 | whether the same be between Broward County and a third party or |
115 | between nongovernmental entities, which contracts are in effect |
116 | prior to the effective date of annexation. |
117 | Section 11. This act shall take effect upon becoming law. |
