2 An act relating to the Department of
3 Corrections; amending s. 944.10, F.S.;
4 providing for the department to preselect
5 certain construction managers based on
6 continuing contracts; applying specific
7 advertising requirements; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (1) of section 944.10, Florida
13 Statutes, is amended to read:
14 944.10 Department of Corrections to provide buildings;
15 sale and purchase of land; contracts to provide services and
16 inmate labor.--
17 (1)(a) It is the intent of the Legislature to expedite
18 the siting of, acquisition of land for, and construction by
19 the Department of Corrections of state correctional facilities
20 operated by the department or a private vendor under contract
21 with the department. Other agencies shall cooperate with the
22 department and expeditiously fulfill their responsibilities to
23 avoid unnecessary delay in the siting of, acquisition of land
24 for, and construction of state correctional facilities. This
25 section and all other laws of the state shall be construed to
26 accomplish this intent. This section shall take precedence
27 over any other law to the contrary
28 (b) Notwithstanding s. 255.29, the process for
29 selecting construction managers for the construction of state
30 correctional facilities may not be project specific, in order
31 to allow the preselection of construction managers for future

1 projects based upon a continuing contract similar to the
2 selection process used for architects and engineers under s.
3 287.055. The advertising requirements for s. 255.0525 apply to
4 the process for selecting construction managers for state
5 correctional facilities.
6 Section 2. This act shall take effect July 1, 2004.

10 Allows the Department of Corrections to preselect certain
construction managers on a continuing contract basis.
11 Applies specific advertising requirements to such
selections.
