A bill to be entitled
2An act relating to Broward County; providing for extending
3the corporate limits of the City of Fort Lauderdale or the
4City of Oakland Park; providing for annexation of the
5unincorporated area known as Twin Lakes North; providing
6for an election; providing for an effective date of
7annexation; providing for an interlocal agreement;
8providing for a continuation of certain Broward County
9regulations; providing for the transfer of public roads
10and rights-of-way; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  No later than July 1, 2004, the governing
15bodies of the City of Fort Lauderdale and the City of Oakland
16Park, after having considered the effects of annexation on the
17residents of both the Twin Lakes North Area, as hereinafter
18described, and the respective municipality, shall inform the
19Broward County Legislative Delegation and the Broward County
20Board of County Commissioners of their desire to appear on the
21ballot as provided for in this act.
22     Section 2.  Twin Lakes North Area legal description.--

181     Section 3.  The Broward County Board of County
182Commissioners shall schedule an election in accordance with the
183provisions of the law relating to elections currently in force
184in Broward County on November 2, 2004. The subject of said
185election shall be the annexation of the Twin Lakes North Area.
186Only registered voters residing in the Twin Lakes North Area as
187described in this act may vote in said election. On the ballot
188provided for in this section shall appear the City of Fort
189Lauderdale and the City of Oakland Park. The voters residing in
190the Twin Lakes North Area shall, by majority vote of the voters
191participating in the election, choose one municipality for
192annexation.
193     Section 4.  Upon a majority of the voters participating in
194the election as provided in section 3, voting for annexation,
195the Twin Lakes North Area described in section 2 shall be deemed
196a part of said municipality on September 15, 2005, pursuant to
197s. 171.062, Florida Statutes, except as provided for in this
198act.
199     Section 5.  An interlocal agreement shall be developed
200between the governing bodies of Broward County and the annexing
201municipality and executed prior to the effective date of the
202annexation as provided for in section 4. The agreement shall
203address infrastructure improvement projects and include a
204financially feasible plan for transitioning county services,
205buildings, infrastructure, waterways, and employees.
206     Section 6.  The Board of County Commissioners of Broward
207County is hereby authorized to set the election provided for in
208section 3 by general election for the time period provided in
209this act at the cost of Broward County. A mail ballot shall not
210be used for any election provided for in this act. However,
211voters may vote by absentee ballot as provided by law.
212     Section 7.  Upon annexation into a municipality, the
213following shall govern the areas described in section 2:
214     (1)  The present land use designations and zoning districts
215provided for under the Broward County Comprehensive Plan and
216Code of Ordinances of Broward County shall remain the law
217governing the Twin Lakes North Area, notwithstanding the fact
218that the Twin Lakes North Area is now a part of a municipality.
219The land use designations and zoning of Broward County shall be
220deemed the conforming laws of the municipality of which the Twin
221Lakes North Area is now a part.
222     (2)  Any change of zoning districts or land use
223designations may only be accomplished by enactment of the vote
224of the majority of the full governing body of the municipality
225plus one.
226     (3)  Notwithstanding subsections (1) and (2), any use,
227building, or structure that is legally in existence at the time
228that the Twin Lakes North Area becomes a part of the
229municipality, said use shall not be made a prohibited use by the
230municipality, on the property of said use, for as long as the
231use shall continue, and not be voluntarily abandoned.
232     Section 8.  Subsequent to the effective date of this act,
233no change in land use designation or zoning shall be effective
234within the limits of the lands subject to annexation herein
235until the Twin Lakes North Area has been annexed into the
236municipality; no annexation within the Twin Lakes North Area by
237any municipality shall occur during the time period between the
238effective date of this act and the effective date of the
239annexation.
240     Section 9.  Subsequent to the effective date of the
241annexation, any resident in the area to be annexed by this act
242into the City of Fort Lauderdale or the City of Oakland Park
243shall be deemed to have met any residency requirements for
244candidacy for any municipal office.
245     Section 10.  Nothing in this act shall be construed to
246affect or abrogate the rights of parties to any contracts,
247whether the same be between Broward County and a third party or
248between nongovernmental entities, which contracts are in effect
249prior to the effective date of the annexation.
250     Section 11.  All public roads and the public rights-of-way
251associated therewith, on the Broward County Road System, lying
252within the limits of the lands subject to annexation herein, as
253described in section 2, are transferred from Broward County
254jurisdiction to the jurisdiction of the annexing municipality,
255except for that portion of Prospect Road described in section 2.
256All rights, title, interests, and responsibilities for any
257transferred roads, including, but not limited to, the ownership,
258operation, maintenance, planning, design, and construction of
259said roads, and to the rights-of-way associated therewith, shall
260transfer from Broward County jurisdiction and ownership to the
261jurisdiction and ownership of the annexing municipality upon the
262effective date of the annexation.
263     Section 12.  This act shall take effect upon becoming a
264law.
