1	A bill to be entitled
2	An act relating to Broward County; providing for extending
3	the corporate limits of the City of Pompano Beach;
4	providing for annexation of specified unincorporated
5	areas; providing for an interlocal agreement; providing
6	for continuation of certain Broward County regulations;
7	providing for the transfer of Broward County roads and
8	rights-of-way; providing an effective date.

10	Be It Enacted by the Legislature of the State of Florida:
11
12	Section 1.  Effective September 15, 2004, the following
13	described lands shall be annexed into and become a part of the
14	City of Pompano Beach:
15
16	That portion of Sections  22, 23, 24, 25 and 26,
17	Township 48 South, Range 42 East, Broward County,
18	Florida, described as follows:
19
20	BEGINNING at the intersection of the Easterly right-
21	of-way line of the Florida East Coast Railway as
22	described in Ordinance No. 80-38 of the City
23	Commission of the City of Pompano Beach with the South
24	right-of-way line of N.E. 24 Street (Copans Road), as
25	described in said Ordinance No. 80-38;

27	Thence Northwesterly and Westerly along said South
28	right-of-way line and along the municipal boundary of
29	the City of Pompano Beach, as described in said
30	Ordinance No. 80-38, through said Section 25 and into
31	said Section 26, to the East line of the West half of
32	said Section 26;

34	Thence Northerly along said East line and along the
35	municipal boundary of the City of Pompano Beach, as
36	described in Chapter 69-1513, Laws of  Florida, to the
37	North line of the West One-Half (W ?) of said Section
38	26;

41	line of the Southeast One-Quarter (SE 1/4) of said
42	Section 22 and along said municipal boundary, to the
43	Easterly right-of-way line of the Seaboard Coastline
44	Railroad;

129	on the municipal boundary of the City of Pompano
130	Beach, as described in Chapter 2000-458, Laws of

134	along said Easterly right-of-way line to the
135	centerline of N.W. 36 Street (Sample Road);

137	Thence Easterly along said centerline to the Easterly
138	right-of-way line of the Florida East Coast Railway,
139	being a point on the municipal boundary of the City of
140	Pompano Beach, as described in Chapter 2000-476, Laws
141	of Florida;

143	Thence Southwesterly along said Easterly right-of-way
144	line and along said municipal boundary to the POINT OF
145	BEGINNING.

147	Section 2.  An interlocal agreement shall be developed
148	between the governing bodies of Broward County and the City of
149	Pompano Beach and executed prior to the effective date of the
150	annexation as provided for in section 1. The agreement shall
151	include a financially feasible plan for transitioning county
152	services, buildings, infrastructure, waterways, and employees.
153	Section 3.  Upon annexation into the municipality, the
154	following shall govern the areas described in section 1:
155	(1)  The present land use designations and zoning districts
156	provided for under the Broward County Comprehensive Plan and
157	Code of Ordinances of Broward County shall remain the law
158	governing the area described in section 1, notwithstanding the
159	fact that the area described in section 1 is now a part of a
160	municipality. The land use designations and zoning of Broward
161	County shall be deemed the conforming laws of the municipality
162	of which the area described in section 1 is now a part.
163	(2)  Any change of zoning districts or land use
164	designations may only be accomplished by enactment of the vote
165	of the majority of the full governing body of the municipality
166	plus one.
167	(3)  Notwithstanding subsections (1) and (2), any use,
168	building, or structure that is legally in existence at the time
169	that the area described in section 1 becomes a part of the
170	municipality, said use shall not be made a prohibited use by the
171	municipality, on the property of said use, for as long as the
172	use shall continue and not be voluntarily abandoned.
173	Section 4.  Subsequent to the effective date of this act,
174	no change in land use designation or zoning shall be effective
175	within the limits of the lands subject to annexation herein
176	until the area described in section 1 has been annexed into the
177	municipality; and no annexation within the area described in
178	section 1 by any municipality shall occur during the time period
179	between the effective date of this act and the effective date of
180	the annexation.
181	Section 5.  Subsequent to the effective date of the
182	annexation, any resident in the area to be annexed into the City
183	of Pompano Beach by this act shall be deemed to have met any
184	residency requirements for candidacy for any municipal office.
185	Section 6.  Nothing in this chapter shall be construed to
186	affect or abrogate the rights of parties to any contracts,
187	whether the same be between Broward County and a third party or
188	between nongovernmental entities, which contracts are in effect
189	prior to the effective date of the annexation.
190	Section 7.  All public roads on the Broward County Road
191	System, and the public rights-of-way associated therewith, lying
192	within the limits of the lands subject to annexation herein, as
193	described in section 1, are transferred from Broward County
194	jurisdiction to the jurisdiction of the City of Pompano Beach.
195	All rights, title, interests, and responsibilities for such
196	transferred roads, including, but not limited to, the ownership,
197	operation, maintenance, planning, design, and construction of
198	said roads and the rights-of-way associated therewith shall
199	transfer from Broward County jurisdiction and ownership to the
200	jurisdiction and ownership of the City of Pompano Beach upon the
201	effective date of the annexation.
202	Section 8.  This act shall take effect upon becoming a law.
