  1                      A bill to be entitled

  2         An act relating to cruelty to animals; amending

  3         s. 828.121, F.S.; providing a definition;

  4         providing that it is a third-degree felony for

  5         a person to intentionally drag or fell by the

  6         tail a bovine animal in an organized sports

  7         exhibition; providing clarification regarding

  8         techniques or practices that are not

  9         prohibited; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Section 828.121, Florida Statutes, is

14  amended to read:

15         828.121  Conduct of simulated bullfighting exhibitions;

16  bulltailing.--

17         (1)  As used in this section, the term "bovine animal"

18  means an animal of the subfamily bovine and includes, but is

19  not limited to, a steer, calf, bull, ox, heifer, or cow.

20         (2)  A It shall be unlawful, and punishable as a

21  misdemeanor, for any person may not to conduct or engage in a

22  simulated or bloodless bullfighting exhibition.

23         (3)  A person may not intentionally drag by the tail or

24  fell by the tail a bovine animal as an organized sports

25  exhibition, also known as "bulltailing."

26         (4)(a)  A person who violates subsection (2) commits a

27  misdemeanor of the second degree, punishable as provided in s.

28  775.082 or s. 775.083.

29         (b)  A person who violates subsection (3) commits a

30  felony of the third degree, punishable as provided in s.

31  775.082, s. 775.083, or s. 775.084.

 1         (5)  This section does not prohibit or otherwise

 2  restrict recognized rodeo or animal husbandry and training

 3  techniques or practices that are not otherwise prohibited by

 4  general law.

 5         Section 2.  This act shall take effect July 1, 2004.

 7          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 8                         Senate Bill 1418

 9                                 

10  The committee substitute differs from the original bill by
    clarifying that the bill is not intended to apply to
11  recognized rodeo and animal husbandry practices that are not
    otherwise prohibited by general law.
