A bill to be entitled
2An act relating to Broward County; amending chapter 2001-
3289, Laws of Florida; authorizing local governments in the
4county to grant an exemption from impact fees for
5transportation facilities for certain developments;
6providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Section 1 of chapter 2001-289, Laws of Florida,
11is amended to read:
12     Section 1.  In addition to the exceptions provided in
13section 163.3180(5)(b), Florida Statutes, a local government in
14Broward County may grant an exception from the concurrency
15requirement for transportation facilities pursuant to the
16provisions of section 163.3180(5)(d), Florida Statutes, if the
17proposed development is otherwise consistent with the adopted
18local government comprehensive plan, and is a project that
19promotes public transportation and is located within a Regional
20Activity Center as described in and defined by the Broward
21County Comprehensive Plan, and is within an area that contains
22major public and private postsecondary institutions of higher
23learning.  The local government also must have considered the
24proposed development?s impacts on the Florida Intrastate Highway
25System, as defined in section 338.001, Florida Statutes. A local
26government in Broward County may also grant an exemption from
27impact fees for transportation facilities if a major public or
28private postsecondary institution of higher learning has an
29interest or an option to obtain an interest of more than 25
30percent in the proposed development and the proposed development
31is otherwise consistent with the adopted local government
32comprehensive plan, is a project that promotes public
33transportation, is located within a Regional Activity Center as
34described in and defined by the Broward County Comprehensive
35Plan, and is within an area that contains major public and
36private postsecondary institutions of higher learning.
37     Section 2.  This act shall take effect upon becoming a law.
