  1                      A bill to be entitled

  2         An act relating to trust funds; terminating and

  3         re-creating the Quality of Long-Term Care

  4         Facility Improvement Trust Fund within the

  5         Agency for Health Care Administration without

  6         modification; carrying forward current balances

  7         and continuing current sources and uses

  8         thereof; repealing s. 400.0239(5), F.S.;

  9         abrogating provisions relating to the

10         termination of the trust fund, to conform;

11         providing an effective date.

13         WHEREAS, the Legislature wishes to extend the life of

14  the Quality of Long-Term Care Facility Improvement Trust Fund

15  within the Agency for Health Care Administration, which is

16  otherwise scheduled to be terminated pursuant to

17  constitutional mandate, and

18         WHEREAS, the Legislature has reviewed the trust fund

19  before its scheduled termination date and has found that it

20  continues to meet an important public purpose, and

21         WHEREAS, the Legislature has found that existing public

22  policy concerning the trust fund sets adequate parameters for

23  its use, NOW, THEREFORE,

24  

25  Be It Enacted by the Legislature of the State of Florida:

26  

27         Section 1.  (1)  The Quality of Long-Term Care Facility

28  Improvement Trust Fund within the Agency for Health Care

29  Administration, FLAIR number 68-2-126, which is to be

30  terminated pursuant to Section 19(f), Article III of the State

 1  Constitution on July 1, 2005, unless terminated sooner by law,

 2  is terminated on November 4, 2004, and re-created.

 3         (2)  All current balances of the trust fund are carried

 4  forward, and all current sources and uses of the trust fund

 5  are continued.

 6         Section 2.  Subsection (5) of section 400.0239, Florida

 7  Statutes, is repealed.

 8         Section 3.  This act shall take effect November 4,

 9  2004.

12                          SENATE SUMMARY

13    Terminates and re-creates the Quality of Long-Term Care
      Facility Improvement Trust Fund within the Agency for
14    Health Care Administration in order to synchronize its
      review cycle with other trust funds of the agency.
