6An act relating to enterprise zones; amending s.
7290.0065, F.S.; authorizing certain counties to apply to
8the Office of Tourism, Trade, and Economic Development to
9amend existing enterprise zone boundaries under specified
10conditions and in accordance with certain criteria;
11creating s. 290.00703, F.S.; authorizing the City of
12South Daytona to apply to the Office of Tourism, Trade,
13and Economic Development to designate an enterprise zone
14within an area of the City of South Daytona; authorizing
15the Office of Tourism, Trade, and Economic Development to
16designate one enterprise zone in the City of South
17Daytona; providing requirements with respect thereto;
18authorizing the governing body of certain counties to
19apply to the Office of Tourism, Trade, and Economic
20Development to amend the boundaries of a certain area
21within a certain enterprise zone; requiring the office to
22approve the application under certain circumstances;
23providing requirements; providing an effective date.

25Be It Enacted by the Legislature of the State of Florida:
26
27     Section 1.  Subsection (12) is added to section 290.0065,
28Florida Statutes, to read:
29     290.0065  State designation of enterprise zones.--
30     (12)  Before November 30, 2004, any county as defined in s.
31125.011 may apply to the Office of Tourism, Trade, and Economic
32Development to change the boundaries of an existing enterprise
33zone for the purpose of replacing an area of not more than 75
34acres within the enterprise zone as of January 1, 2004, with an
35area of the same number of acres outside the enterprise zone as
36of January 1, 2004. The replacement area must be contiguous to
37the existing enterprise zone and must be a part of a
38revitalization area that has been targeted for assistance by the
39county. The replacement area also must be contiguous to a zoo
40and the county must have previously completed a master plan for
41development of the area. The Office of Tourism, Trade, and
42Economic Development shall approve the amendment effective
43January 1, 2005, if the enterprise zone remains consistent with
44the criteria and conditions imposed by s. 290.0055 upon the
45establishment of enterprise zones, including the requirement
46that the area suffer from pervasive poverty, unemployment, and
47general distress.
48     Section 2.  Section 290.00703, Florida Statutes, is created
49to read:
50     290.00703  Enterprise zone designation for the City of
51South Daytona.--The City of South Daytona may apply to the
52Office of Tourism, Trade, and Economic Development for
53designation of one enterprise zone within the city. The
54application must be submitted by December 31, 2004, and must
55comply with the requirements of s. 290.0055. Notwithstanding the
56provisions of s. 290.0065 limiting the total number of
57enterprise zones designated and the number of enterprise zones
58within a population category, the Office of Tourism, Trade, and
59Economic Development may designate one enterprise zone under
60this section. The Office of Tourism, Trade, and Economic
61Development shall establish the initial effective date of the
62enterprise zone designated under this section.
63     Section 3.  Notwithstanding any other provision of chapter
64290, Florida Statutes, the governing body of any inland county,
65with a state-designated enterprise zone and a population greater
66than 500,000, may apply to the Office of Tourism, Trade, and
67Economic Development to amend the boundaries of such an
68enterprise zone. The increased areas shall be contiguous to the
69existing enterprise zone. The office shall approve the
70application as long as the amended area does not exceed 5 square
71miles and is consistent with the categories, criteria, and
72limitations imposed by s. 290.0055, Florida Statutes, upon the
73establishment of such enterprise zone. The enterprise zone
74boundary amendment application must be received before December
7531, 2004.
76     Section 4.  This act shall take effect July 1, 2004.
