1 A bill to be entitled
2 An act relating to Medicaid copayments;
3 amending s. 409.9081, F.S.; requiring Medicaid
4 recipients to pay a specified amount per month,
5 subject to federal regulations and limitations;
6 deleting provisions requiring copayments for
7 certain medical services and prescription
8 drugs; providing for the proceeds of the
9 payment to be deposited into the Public Medical
10 Assistance Trust Fund; providing an effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsection (1) of section 409.9081, Florida
16 Statutes, is amended to read:
17 409.9081 Copayments.--
18 (1) The agency shall require, subject to federal
19 regulations and limitations, each Medicaid recipient to pay
20 $20 per month. Payments collected under this subsection shall
21 be deposited into the Public Medical Assistance Trust Fund. at
22 the time of service a nominal copayment for the following
23 Medicaid services:
24 (a) Hospital outpatient services: up to $3 for each
25 hospital outpatient visit.
26 (b) Physician services: up to $2 copayment for each
27 visit with a physician licensed under chapter 458, chapter
28 459, chapter 460, chapter 461, or chapter 463.
29 (c) Hospital emergency department visits for
30 nonemergency care: $15 for each emergency department visit.

1 (d) Prescription drugs: a coinsurance equal to 2.5
2 percent of the Medicaid cost of the prescription drug at the
3 time of purchase. The maximum coinsurance shall be $7.50 per
4 prescription drug purchased.
5 Section 2. This act shall take effect upon becoming a
6 law.

9 SENATE SUMMARY
10 Requires Medicaid recipients to pay $20 per month which
shall be deposited into the Public Medical Assistance
11 Trust Fund. Deletes requirements that Medicaid recipients
make certain copayments for medical services and
12 prescription drugs.
