10 | Be It Enacted by the Legislature of the State of Florida: |
11 |

12 | Section 1. As used in this act: |
13 | (1) "Public body" means any entity created by the Florida |
14 | Constitution, by general or special law, or by ordinance and |
15 | operating within the geographic boundaries of Hillsborough |
16 | County. |
17 | (2) "Publicly advertised competitive sealed bidding |
18 | process" means a process of receiving two or more sealed bids or |
19 | proposals submitted by responsible vendors who respond to an |
20 | invitation to bid or request for proposals solicited in a manner |
21 | compliant with state law. The invitation to bid must include a |
22 | detailed description of the goods and services sought, the time |
23 | and date for the receipt of bids and of the public opening, and |
24 | the contractual terms and conditions applicable to the |
25 | procurement, including the criteria to be used in determining |
26 | acceptability of the bid. Solicitations for invitations to bid |
27 | or requests for proposals include solicitations that are |
28 | electronically posted as authorized under state law. |
29 | Section 2. The purpose of this act is to facilitate the |
30 | purchase of goods and services by a public body by enabling a |
31 | public body to engage in cooperative purchasing practices with |
32 | other federal, state, and local governmental entities. |
33 | Section 3. A public body may purchase goods and services |
34 | under the terms of a bid submitted to and accepted by any other |
35 | federal, state, or local governmental entity and under the terms |
36 | of a contract with such other governmental entity, provided that |
37 | such bid or contract results from a publicly advertised |
38 | competitive sealed bidding process. |
39 | Section 4. Any cooperative purchase made under the |
40 | provisions of this act is exempt from the requirements for |
41 | advertising for bids and for competitive sealed bidding |
42 | otherwise applicable to such purchases, provided that the |
43 | governmental entity that acts as a purchasing partner to a |
44 | public body has complied with the requirements of a publicly |
45 | advertised competitive sealed bidding process. |
46 | Section 5. This act provides a supplemental, additional, |
47 | and alternative method of purchasing and is not in derogation of |
48 | any purchasing powers now existing, including the powers |
49 | provided for in chapter 69-1119, Laws of Florida. |
50 | Section 6. This act shall take effect upon becoming a law. |
