11 Senator Campbell moved the following amendment:

13 Senate Amendment (with title amendment)
14 On page 25, between lines 15 and 16,
15
16 insert:
17 Section 18. Present subsection (4) of section 335.02,
18 Florida Statutes, is redesignated as subsection (5), and a new
19 subsection (4) is added to that section, to read:
20 335.02 Authority to designate transportation
21 facilities and rights-of-way and establish lanes; procedure
22 for redesignation and relocation; application of local
23 regulations.--
24 (4) If any rule, ordinance, or regulation of any
25 county, municipality, or special district, including any
26 instrumentality thereof, directly conflicts with an existing
27 rule or policy of the department, or if the local government
28 rule, ordinance, or regulation imposes a substantial financial
29 expense or delay in the planning, construction, operation, or
30 maintenance of a transportation facility or project, the
31 appropriate district secretary of the department or his or her

1 designee shall inform the chief administrative officer of the
2 local government, in writing, of the identified conflict,
3 additional expense, or delay. The local government and the
4 department shall thereafter meet to resolve the identified
5 conflict, additional expense, or delay. If the local
6 government and the department are unable to resolve the
7 identified conflict, additional expense, or delay within 15
8 business days, or longer if mutually agreed, after the
9 department's written notification to the local government
10 entity, the department must notify the Governor before
11 proceeding to the next phase of the facility or project
12 implementation and the department may not proceed any further
13 with the current or subsequent phase until action is taken by
14 the Governor to resolve the conflict, additional expense, or
15 delay.
