6An act relating to land surveying and mapping; amending s.
7472.019, F.S.; authorizing and providing conditions,
8including fees, for the reinstatement and reissuance of
9licenses for certain individuals whose licenses became
10null under specified circumstances; providing for future
11repeal; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Section 472.019, Florida Statutes, is amended
16to read:
17     472.019  Reactivation; continuing education;
18reinstatement.--
19     (1)  The continuing education requirements for reactivating
20a license may not exceed 12 classroom hours for each year the
21license was inactive.
22     (2)  The board shall promulgate rules relating to licenses
23which have become inactive and for the renewal of inactive
24licenses. The board shall prescribe by rule a fee not to exceed
25$50 for the reactivation of an inactive license and a fee not to
26exceed $50 for the renewal of an inactive license.
27     (3)  Notwithstanding the provisions of s. 455.271, the
28board shall reinstate and the department shall reissue by July
291, 2005, the license of an individual whose license has become
30null, provided all of the following circumstances and
31qualifications are met:
32     (a)  The individual's license was scheduled to be renewed
33during the biennium period beginning in 2001.
34     (b)  The individual did not receive actual timely license
35renewal notice, as attested to by a signed and notarized
36affidavit of the individual.
37     (c)  The license of the individual was in good standing at
38the time of the beginning of the renewal cycle.
39     (d)  The individual properly petitioned the department for
40relief relating to the circumstances under which the license
41became null.
42     (e)  The department failed to grant or deny the license
43renewal petition within 90 days after receiving the petition, as
44required by the Administrative Procedure Act and s. 120.542.
45     (f)  No felony or practice act or unlicensed activity
46penalties have been imposed upon the individual for violations
47occurring during the period the license was null.

49The individual shall submit an application to the board for
50reinstatement in a manner prescribed by rules of the board and
51shall pay the appropriate application fees in an amount equal to
52the fees imposed for current applicants for new licensure. This
53subsection expires July 1, 2005.
54     Section 2.  This act shall take effect July 1, 2004.
