10 | null under specified circumstances; providing for future |
11 | repeal; providing an effective date. |

13 | Be It Enacted by the Legislature of the State of Florida: |
14 |
|
15 | Section 1. Section 472.019, Florida Statutes, is amended |
16 | to read: |
17 | 472.019 Reactivation; continuing education; |
18 | reinstatement.-- |
19 | (1) The continuing education requirements for reactivating |
20 | a license may not exceed 12 classroom hours for each year the |
21 | license was inactive. |
22 | (2) The board shall promulgate rules relating to licenses |
23 | which have become inactive and for the renewal of inactive |
24 | licenses. The board shall prescribe by rule a fee not to exceed |
25 | $50 for the reactivation of an inactive license and a fee not to |
26 | exceed $50 for the renewal of an inactive license. |
27 | (3) Notwithstanding the provisions of s. 455.271, the |
28 | board shall reinstate and the department shall reissue by July |
29 | 1, 2005, the license of an individual whose license has become |
30 | null, provided all of the following circumstances and |
31 | qualifications are met: |
32 | (a) The individual's license was scheduled to be renewed |
33 | during the biennium period beginning in 2001. |
34 | (b) The individual did not receive actual timely license |
35 | renewal notice, as attested to by a signed and notarized |
36 | affidavit of the individual. |
37 | (c) The license of the individual was in good standing at |
38 | the time of the beginning of the renewal cycle. |
39 | (d) The individual properly petitioned the department for |
40 | relief relating to the circumstances under which the license |
41 | became null. |
42 | (e) The department failed to grant or deny the license |
43 | renewal petition within 90 days after receiving the petition, as |
44 | required by the Administrative Procedure Act and s. 120.542. |
45 | (f) No felony or practice act or unlicensed activity |
46 | penalties have been imposed upon the individual for violations |
47 | occurring during the period the license was null. |

49 | The individual shall submit an application to the board for |
50 | reinstatement in a manner prescribed by rules of the board and |
51 | shall pay the appropriate application fees in an amount equal to |
52 | the fees imposed for current applicants for new licensure. This |
53 | subsection expires July 1, 2005. |
54 | Section 2. This act shall take effect July 1, 2004. |
